I hope you have filed a Hit & Run case already! An FIR is a must and should should be done to keep you safe from allegations from the other party.
If you have an evidence to prove that the other person is guilty, you can take him to court, or agree for an out of court settlement with proper sign off from the police dept.

That's all I can say in the matter, something you may already know.

This is a very old thread and hope the problem was solved. In such cases we cannot do anything except calling the police or filing an FIR (only if the matter is too serious). Let it go and enjoy your bike.
