  • Registering an unregistered Superbike

    Hi everyone

Well I have a 06 GSX R1000 which was imported in parts for a project I wanted to undertake, how ever I would like to know if it is possible to register the bike and pay duty if I chose to assemble it, I have proof of ownership for the bike for a duration of just under 2 years in the US and the bike was disassembled after a minor accident after which I decided to experiment with it rather than fix it up or claim insurance and sent the bike to India in parts during 2012, how ever the bike was in top running condition and can be re-assembled to its old condition and fixed if I choose to do it.

I would like to know what would the procedure be if I would choose to reassemble it and register it, I have all documents pertaining to ownership, registration, insurance, Title and Bill of Sale and a customs invoice for 35% tax paid on the depreciated value of the parts,
If I were to re-assemble it is there any procedure using which I could register it legally by paying additional taxes and or customs clearance charges.

Any info on the same would be highly appreciated

I am looking for complete procedure to register a DRI Auction bike.
A friend in Delhi owns a CBR 600 F4i which is an DRI auction bike and its still not registered.
Can some one throw some light on the step by step procedure about how to get it registered thru the Delhi RTO.

Replying to the OP on his GSXR1000, please be advised that DRI are tracking superbikes either at customs clearance point or RTO registration point. Even the slightest paperwork anomaly and they make your life miserable.

Now coming to importing bike as parts that happened in the past, it was a loophole in customs law of damaged/scrapped bike that could be individually assessed by a customs inspector (if he was your 'friend', he could value it at a low price), however, the last I knew they had a strict procedure that a damaged bike has to be classified as scrap and in that form the RTO cant register it. I am however, not able to comment if there are some smaller cities, towns where you could register it thru the back door.

Back in 2006, a friend on a visit Saudi Arabia bought a new Hyabusa and asked me to dismantle it saying "he has his guys in customs and can import it as parts and then some known guys in RTO to register the bike" etc. Well 5 month later with innumerable visits to customs, answering to vigilance, & paying customs & fines to the tune of Rs 14 lakhs, he finally cleared the bike (total cost of bike at his doorstep a whooping Rs 21 lakhs). So it may not be so easy to now re-assemble the bike as the customs would not buy the story that you had dismantled it for your research purposes. They will maintain, you tried to fool them and hence dismantled the bike and illegally brought it in. It is most likely you may end up paying a fine & other troubles with customs. BTW, if you are an NRI, you can import a used bike, but non-NRIs can not import USED bikes.

Thanks a lot for the reply's,

            Update

Well the Bike was actually imported for a "mechanical engineering project"which did not "materialize" , hence I was still left with the bike,

I went to the Rto Officials at Bangalore to inquire and they seemed absolutely clue less and when they realized that the amount of money involved would be potentially huge suggested that I register the vehicle as a custom built motor vehicle, with a VIN assigned by the RTO and a new RC.

The cost was a bit steep, so I would like to know if this would be legal and If I would face any hassles if pulled over by cops with documents stating it is a custom vehicle, how ever judging by the amount of empty palms at the RTO, I hope that the with the amount of money I spend on the bike I would be able to ride it with no legal issues.

Can someone please throw some light on NRI importing used bikes. How can they get registered? How much duty/taxes might that attract? Would it be a hotcake for the DRI? Can it be resold / reregistered to a non-NRI?

well to legally do that would be not just time and money consuming but would be extremely taxing on your nerves too.

any kind of custom vehicle (or modified) needs to go through another set of tests at ARAI and needs to be approved as road legal from there to get any RTO to register it.
that ofcourse is out of question as these people are quiet strict about their norms and even automobile manufacturers need to jump quiet a lot of loops and hurdles to get their approval.

getting your bike assembled is not an issue - but legally getting it registered would be quiet a task. in short - there is no way that you can get it registered legally after assembling it. you can get it registered in some smaller town maybe BUT the risk of getting the bike confiscated by DRI would be as high as any grey market import.
if you are lucky - you might not be caught but god forbid they do get hold of you - you are in BIG trouble!!

there is no foolproof way that you can get out of this mess. other than that you take it out as parts again - assemble it and then bring it back after paying the relevant duties.
else - sell off the parts online
Biking is a religion, not a hobby!!

Its a long process but I shall summarize it in as simple terms as I can (from my own painful experience). This is the general procedure I am explaining so if you have any questions, you will need to go thru the process yourself to get the BEST ANSWERS!

                    First Step:
-The NRI should have continuously owned the bike for atleast 1 year abroad and then he is allowed to bring it under TR (Transfer of Residence- That means you can not avail this facility more than once within a span of 3 years (the customs just writes it in your passport you have availed TR). So after importing, you can immediately go back to the foreign country and continue to work as usual and continue your NRI status)
-So then you ship the bike to the seaport of your choice- Mumbai, Cochin or Chennai

                    Second Step:
-You furnish all the export docs including your shipping invoice, shipping insurance and other details of the bike including your original purchase invoice to customs.
-Customs will inspect the bike and then determine the original cost of bike as per model year. They give depreciation (max 70% depending on how many years old the bike is- The depreciation structure has been explained somewhere else in one of the hundreds of "I want to import a bike...." threads).
-There is a 15% trade discount also they allow on the original price of the bike
-Based on all the above, the figure is arrived at. They then add the shipping and insurance cost that you have incurred and then arrive at the 'assesed value'
-The customs duty and some cess etc all works out to 136% of the assesed value for used bike.
-You have to pay the customs duty thru the ICEGATE portal online ONLY. No DD or cash etc
-After that they release the bike to you with the Customs Payment Receipt in which it is clearly written 'that you can not sell the bike for 2 years'. Before that they enter in your passport also that you have availed TR.

Note: I have explained in simple steps, but in reality you have to go to various offices probably on various floors the same day, various officers, various assistants, warehouse, security etc...takes anything from 4-7 working days or more

                    Third Step:
-You have to take the customs documents, ID and address proof etc and first do a temporary insurance
-Then take this insurance policy, ID, customs payment document, forms etc and submit to RTO
-RTO/Transport department will assess the total value of the bike and tell you the Road Tax/Life Tax to be paid.
-You make a DD and submit to RTO
-Then RTO will send a copy of your customs payment document to the relevant customs office (where you cleared your bike) for verification.
-The Customs office has to verify and confirm directly back to RTO 'Yes, the receipt you furnished is correct and thats the exact amount of duty you paid'
-Then the RTO will issue the registration certificate/number plate

Note: This RTO process can take anything from 3 weeks to 2 months or more....

AND THEN YOU FIX THE INDIAN NUMBER PLATE AND RIDE INTO THE HORIZON!
