    In a boost for India's leading two-wheeler manufacturer Bajaj Auto, the Chennai bench of the IPAB or the Intellectual PropertyAppellate Board has dismissed an appeal filed by rival LML Ltd which had sought the revocation of a patent granted to Bajaj AutoBSE -1.18 % on air & fuel intake systems for engines.

    Bajaj Auto was granted the patent for an intake system for two-stroke engines used in two-wheelers that would result in improved fuel efficiency and reduced emissions.

    LML had moved the IPAB in 2007 arguing that the claimed invention was not novel and a minor rearrangement of technology in the public domain.

    "The IPAB verdict upholds the validity of the patent as the bench has held that it is an inventive improvement over prior patents which made the invention in question more useful and efficient. LML Ltd is likely to challenge this verdict by filing a writ petition at the Madras High Court," said an individual familiar with the case.

    When contacted, a Bajaj Auto official said the company was "pleased with the verdict and was examining it in detail ." Bajaj Auto was represented by advocate Mihir Kumar Chakrabarti while LML Ltd was advised by law firm Kurian & Kurian Advocates.

    I hope members are not surprised by a fight over supposedly a thing of the past, 2 stroke engines, because they are not yet dead. They are still present in some mopeds, scoots, three wheelers, etc. The technology can be usable anywhere. Even if one doesn't use the technology itself, the technology can still be licensed to some other company.

    The moral of the story here is simple: If minor changes bring about major benefits, then the changes by themselves don't remain minor. Its all about the benefits derived.

      I guess there was a piece of news recently where LML officials were planning to relaunch the Freedom and some scooters including 2 strokes.

      Must say, Bajaj have kept their future insured...but wait...are they planning a re-entry into the 2S segment too?

        i was actually about to ask the same question which you tried to answer, but i am still not satisfied. which mopeds, scoots & 3 wheelers are in production using 2 stroke petrol engines. and which of them are produced by bajaj or LML.since LML itself went almost extinct, they might have not pursued the case aggressively.

          Few months back there has been lot a speculation that a new two stroke bike will be launched when Bajaj announced about a new premium 100cc bike, but we all know that actually it was D100T which got launched. Nobody has a clear evidence that Bajaj is still working on this technology. However as Bajaj is still fighting it out in the courts should mean something.

          LML is pursuing the case vigorously. The article says LML is contemplating to appeal the verdict in Madras High court.

            i said that LML might not have pursued the case actively when it almost went extint, i.e. when it was not selling anything, now that it has woken up from sleep, its but obvious that they will follow the case actively.
