  • Can they legally tax me?

    I went to Bajaj SVC yesterday to get my 2nd service done. As usual ther was a lot of hoopla and hungama over every little thing.
    They did not have the engine oil in stock so if I had to get my engine oil changed, I need to be on their knees tomorrow or anytime (as if I got my bike for their ease)
    Initially they told me my bill amount is 35 Rupees
    I asked them the details, Battery charging was the reason
    I told them the mech did not even touch the battery.
    She called the mechanic, he took the tester and started moving ahead and asked me "sir, bike kaha khadi hai".....

    I just looked at the lady and told her, please confirm before charging!
    Anyways, my final bill came out to be 8 rs....!

    My question is "Can they Labour Tax me for a FREE service.
    Can I be taxed for anything which is free.....?
    All I want to know is, Is it legally correct...?

    2nd Free servicing -- 75.00 (free)
    Labor Service Tax @ 10% -- 7.5
    Education Cess --- 0.23
    Labor Total --- 7.73

          Believe me it doesnt have anything to do with those 8 rupees
          This is a much deep rooted issue and I might not hesitate in going any bounds against Bajajs service.

          But before that I need to know whether they can charge me or not LEGALLY?

          The bigger is the fact that (at least in Pune) everybody gets charged for the same reason and yet many do not know about it...!

            i havent heard anyone getting tax charged for free labour here from TVS/Bajaj/hh but im not 100% sure of the legal technicalities

              If you have paid anything for labour, then they are entitled to charge service tax on that amount (10 something percent). If you paid nothing against labor, they cannot charge for any tax.

              But how can they charge labour for a free service? Absolutely unacceptable. In fact, you should make it very clear that you don't wan't anything chargable done on your bike without first asking you (on phone, if necessary). If your bike was in regular use, you have not fitted any accessories, then chances of a new battery on a new bike requiring charging is nil. If it requires charging, then something is wrong, which should be fixed in warranty anyway.

              They seem to have simply put a random header for the charges they have wrongly billed you for. Suggest you put up a stiff fight.

                and check with them that when they re-imburse the coupon that they submit to the company, does the company pay them the pre tax amount or the entire billed amount??? i think this is just skimming of the cheapest kind... burn em to hell!!

                  As I earlier said, SHIRODE BAJAJ charge EVERYONE with the battery maintenance charges and labor service tax (for Free service) where it is clearly mentioned in the owners manual that it comes under the jobs to be carried out in free service.
                  YET PEOPLE HERE IN PUNE DO NOT GIVE A DAMN TO THAT
                  THEY HAPPILY PAY FOR THINGS WHICH SHOULD NOT BE PAID.
                  Things would further worsen if we do not put up an opposition.
                  Only mass appeals are heard and one or two guys here or ther are taken for granted.

                  Please check what are you paying for. Most of us are educated...!

                    AFAIK, There should be no billing on labour (for free svc). Only consumables can be charged (grease, E-oil, rubber,gasket) which has only MRP component (I mean a HH engine oil costs Rs. 170/-MRP in billing it will read as Rs.149.6 and Rs.20.4 as tax).

                    So complain to Bajaj toll free...

                      shudnt be charging for labour in a free service!

                      For all my 4 free services till date, i have been charged only Rs175, that too for the engine oil.

                          Yamaha SVC dont charge anything for Free service. Something is wrong with Bajaj.

                              They can't charge you service tax / VAT as it clearly states 10% of you charges. If labour charges is zero rupees your service tax should be zero as well. You can go to the consumer court.
