    Any violation of Section 52 of the Motor Vehicles Act, like removal of silencers, shall be viewed seriously and appropriate action taken.

    Motor Vehicles Department and police told to ensure standardisation of customised vehicles.

      I believe the issue is not the court , it is only upholding what is written in MV act. The issue is the MV act itself, which is outdated and long in tooth for the current scenarios.

      I hope they limit the implementation of this ruling to only the aftermarket exhaust's, otherwise we will have chaos on the roads. Though it would be unfair to those full free flow systems that are less noisy, there is no other option for owners I guess. At least till this crackdown is over, they should revert to stock.

      Also it would be funny to see Harleys and 'busa's running about with saree guard.

      And why only motorcycles, in Kerala at least I guess there are more ricers nowadays with FFE on their Jazz and Civics with lowered suspension and 20" wheels.

      However, in my opinion, we the riders cannot remain divided as a fringe minority. In our democracy, being unorganized means being sh*t upon by everyone else. Various riding groups on a pan-India level should join to form a legal team and obtain a stay on this order, till the MV act itself is studied and revised in accordance with the present times.

      PS. I cannot understand how saree guard, handle bar, mud guard, etc comes in the purview of MVA however, quoting from section 52; "For the purpose of this section, "alteration" means a change in the structure of a vehicle which results in a change in its basic feature". Who defined what are these "basic features"?

      PPS. Instead of banning motorcycle without saree guard, what the Hon'ble High court should have done is ban women in saree from riding on a motorcycle. Period. Honestly, a saree is the worst form of apparel on a motorcycle. They have to sit on one side thus hampering the weight distribution, even on a Splendour, their pallu will be flying all over the place, etc. Ban also putting children on tank top, in between pillion seat etc. A motorcycle is no place for a toddler. Period. I mean whole family of 5 travelling on motorcycle, with only moron Dad wearing helmet. So in event of a minor accident, moron Dad would survive, but not his rest of the family.

        I agree with court decision only on the Exhaust part. Nowadays it has become a fashion to replace stock silencer & fit a louder Pipe specially in RE bikes..There are a lot of pepole who are restoring cast iron Bullets just for that loud thump.

          Agree on the ricers' part. Far too many with 20" rims and stuff. Marutis with spoilers. Ha ha!

          Busa is safe. MV act demands saree guards only up to bikes displacing 999cc.

            Its bullocks, this judgement ... on the R15; there is never going to be a saree clad female sitting, whose safety we need to ensure. Are they going to enforce that as well.

            In Cyberabad/Hyderabad, all the Traffic police are a bunch of Goondas in uniform who, all they can and do all day is writing challans at some junctions while there is mayhem everywhere.

            Its is the rider that is the 99% of the time the faulty equipment on the bike. If any thing they should concentrate more on educating riders more, enforcing them to follow traffic rules that endanger lives ... not ridiculous things like these.

            The intrusion of the state on things that really matter while ignoring critical things which matter is what appalls me. The sorry state of affairs this ... upholding archaic and ridiculous laws.

            In Hyderabad these are the fines .... shows the maturity and intelligence of these people who have designed the laws. Where as ... lack of PUC is Rs. 1000/- and Noise Pollution is Rs. 1000/-

                Whatever is coming out from an assembly line is officially legal. So, owners of Busas and R1s shouldn't be worried as long as they are not modifying their machines.

                    Any vehicle that goes through ARAI certification requires a saree guard. CBUs don't come under this purview.

                      This only means that cops will be even more on lookout for handing out challans rather than looking for people who've run a red light, or an accident victim in need of assistance.

                          Modified Motorcycles to be banned in Kerala

                          The kerala High Court has ordered the state government to take strict action against people who are using modified motorcycles. According to the experts of Motor Vehicle Department (MVD), the altered vehicles are one of the major polluting agents in the city.

                          Justice C. Chidambaresh said,
                          Following the court orders, Motor Vehicle Department officials and Ernakulam regional transport office booked 30 Enfield motorcycles owners for altering their bikes.

                          Naufal, Motor Vehicle Inspector said,
                          The modified vehicles, especially the motorcycles with altered exhaust are one of the major polluting agents in the city. According to kerala State Pollution Control Board, the fuel emission possess high risk to ozone layer depletion.

                          Recently Motor Vehicle Department, have seized around 190 vehicles and suspended their fitness certificates citing road unworthiness.

                          K M Shaji, RTO said,
                          In order to get the suspension of such vehicles revoked, owners have to switch back to the original parts.
