  • Issue related to bike documents

    Hello Everyone,

I got a second hand Ninja 650 on 14th Of June, 2016. Paid the owner by online bank transfer. He gave me the bike and a copy of the RC. He runs a transport business and hence said that he will get the ownership transferred by his RTO agents. He got my signature on Form 29 and 30 and also took a copy of my local address proof.
However till date have not received the RC. Last month he gave me the original tax invoice.
Since last week he has stopped receiving my call and doesnt respond to my messages as well (whatsapp and sms).
I think he is local from Bangalore and I am not.
I am really at a loss as to what should I do now to get the bike documents and also some compensation if possible.
Any help would be highly appreciated.

    Thread Approved

There are two probabilities. One he has swindled you in some way! Then you better think about taking legal action.

Though since he has given you the other invoice etc. Chances are that he has not done any such thing. If he had got you to sign the Form 29 and 30 along with taking an address proof. He has probably submitted the Original RC at the RTO, and the RTO will directly send the new RC to your given address. He cannot do anything about it.

What you can ask him for is the receipt given by the RTO when he would have submitted the Original RC along with the two Forms. You can then follow it up at the RTO yourself. Also on this receipt you will be able to see when did he actually submit the documents to the RTO.

If the bike is with you, and you have transferred funds to his account via the bank, you have not much to worry about. If he has not submitted the papers at the RTO yet, then on record he still is the owner of the bike and any 'incident' the bike is involved in now will land him in trouble. So it is detrimental to his interests i believe.
Biking is not about what you have between your legs, its all about how well you use it!!!!!!!

the last answer actually sums it up from all aspects! If you have the bike, and its runnung well, the only thing you need to do is approach him in person, take the RTA receipts, Follow up with the RTA.

This person is again making me run in circles. Now he is promising to call me back and then switches off his mobile. Can someone please point out to me what legal options I have here and what are the implecations of going legal?
