  • Process to Terminate Hypothecation

    Hope this will guide you through actual "Termination of Hypothecation" process. Though the process differ from place to place, basics remain the same.

    Place: Bangalore, K R Puram RTO
    Done by: Self
    Total expenditure: 123 Rs


    Went to K R Puram RTO all by myself and submitted application for removal of hypothecation.
    For your information, this is a new building (yellow color) which is just 300 m further up the service road on the same side where you were taking a turn inside.
    Initially I wanted to go via an agent (hassle-free) who incidentally asked for 1500 Rs. I was not ready, so I told myself to "try self".
    I got the below documents.
    1. NOC (Original, issued by finance company)
    2. 2 nos. Form 35 (Original, issued by finance company). You need to address "KR Puram RTO", put the date and sign (I did not do any of these initially but later instructed by the clerk to do so: see step 3 below)
    3. Original RC Smart card (put this inside a polythene packet so that you can staple this to other papers)
    4. Xerox copy of PUC
    5. Xerox copy of Insurance
    6. Envelop (with cloth lining inside) with postage (12 Rs stamp affixed) for which I paid 20 Rs from a shop outside RTO Office. Write the address where the new RC to be mailed with your mobile number
    7. A file-folder (just a folded brown sheet in which you are supposed to attach all the documents). Paid 3 Rs. for this from the same shop from where I got the envelop

    Steps:
    1. Put all the papers in this order: NOC, Form 35s, Insurance, PUC, envelop and put them inside the file folder
    2. Once you enter the building, you are on 1st floor actually (not ground floor) and go straight to 2nd floor. See an entrance with a list (of activities ) on the wall on your left side.
    3. Approach the right side "cabin" counter and hand over the bunch of papers to him (as you made it ready in Step 1.). He will check and tell you if all are correct. He will staple the envelop to the front sheet of the file folder and the rest to the other sheet of the file folder. Accidentally I did not sign or write anything on the form 35s. He asked me to write 1. "To the RTO, K R Puram", 2. Date, and 3. sign on both the form 35s and write "To the RTO, K R Puram" on the NOC. He also wrote "100 Rs" on the NOC and asked me to get a challan for 100 Rs.
    4. On 1st floor I showed the documents to the Cash counter and paid 100 Rs. Got "2 copies" (original and carbon copy) of the challan
    5. Staple the RC Smart card (inside polythene packet) and the 2 copies of challan on top of the documents (that are already stapled to the right side sheet of the file folder)
    6. Go to 3rd floor and hand over to the person sitting just next to the cabin counter. She will give you an acknowledgement with your name, vehicle number and challan number written on it. Have this for your future reference. She told me that I will get the new RC Smart card in 30 days.


    Will update you all when I get the new one.


    On 34th day received the RC Smartcard. It is the same one that I have been using. So I believe they have removed the hypothecation from their database.

      I have purchased the bike in 2004 and taken a loan from Bajaj finance, after completion i didnt paid much attention for removal of hypothecation from RC, my bike is Delhi registered. Last week i obtained NOC from the finance company.

      The problem is that i am currently residing in Gurgaon and my bike is registered in Delhi seeikh sarai RTO. And i have read somewhere to rremove the hypothecation address proof is required and i dont have any address proof of Delhi because i am shifted to Gurgaon. I just want to remove the hypothecation , can anybody tell how to get hypothecation removed from RC in my case. I dont mind getting it done through any Agent, how much getting from agent will cost?

      Any suggestion how to get this thing done..!!!

        In Bangalore, an agent charges Rs. 1000 to 1200. In Delhi it will be less I guess. Also, I do not think that they need "address proof". You need to provide your new address to the finance company (my finance company was Bajaj Finance and first time they goofed up the address but I called them and asked them correct that and resend me. They asked me to send them new address proof via email so that they could send me the NOC to that address also to mention that address on the NOC) and then provide the same to RTO as well to get the NOC to be sent to new address. Also, there is a process of address change of the vehicle, I guess you can check out with the RTO and combine 2 processes together.

          I have obtained the NOC and required document from Bajaj Finance but to get the HT removed from RC i required some valid proof that i am resident of Delhi like Voter ID, passport etc., even they dont accept the rent agreement, my major problem is that now i am shifted to Gurgaon which comes under NCR but falls under Harayana. I am not sure how to get this done, without HT removed i am not able to sell or move my bike to different state. Not sure what to do..

            @rajpandey10: Did the RTO tell you that they need address proof? I am asking this because nobody asked me to submit any address proof. See my post where I listed the names of documents that I submitted.

              Yes, RTO requires address proof for hypothecation removal and agent is asking 4K for this. I had one question what if i sell the bike? i have all the required papers except my address proof. suppose if i sell the bike then do i need to remove hypothecation in my name and then need to transfer or HT removal and transfer will required the papers of the person who is buying my bike?
