    Friends, Indians, country men, lend me your ears;




    I come to speak about Kerala High Courts rule/ modifications being made to motorcycles, directive to Motor Vehicles and Police Department Traffic Police to take stringent action against customized modification of motorcycles.

    Though I am not a big fan of custom motorcycles I feel this rule is being misused by the Kerala Motor Vehicles Department, Kerala Police and the Traffic Police and even the Traffic wardens deployed to help manage the traffic at key locations. They are actually using this rule to harass and belittle and fine motorcyclist who has changed from the stock to an aftermarket exhaust, silencer, handle bar, crash bar, head lights, halogen bulbs,horns, seat and the list goes on. There have been many instances where the Police have confiscated the motorcycles and the aftermarket exhausts have been taken away and destroyed and instances where a packet of salt was put into the petrol talk of a motorcycle taken into custody and fines being imposed on whims and fancies of Police officers in Kerala. I think this is gross injustice towards an individual and a gross violation of fundamental rights and right to personal property.




    Points to Ponder:




    1.An individual does not make any after market items, it's sold in the open market by companies and the state government/ central government is getting a tax on the sales of these items and these items are not illegal.

    Why is the individual penalized and insulted?

    2.All motorcycles sold in India are produced for the masses but not all the motorcyclists have the same physical features, height ,weight, some may be tall, some short and why cant the customer can opt for a seat or handle bar which is comfortable for the individual?

    3.The items that come stock with the motorcycle are not the best in the class. There is always option for improved aftermarket exhausts, lights, brakes, air filters, horns, tyres, seats, spark plugs etc.

    4.The customer has to pay 15 years road tax in advance at the time of purchase of the motorcycle, and the Police threaten with withholding the registration of the motorcycle.

    5 When the government comes with BS4 version then the sales of all the non B S4 compliant items like BS3 stock silencer/ exhaust is stopped!




    6.There is not a steady and smooth supply of spares and accessories from the motorcycle manufactures, some time aftermarket spares and accessories is the easy and convenient option available.

    7.The Honorable High Court Judge who passed this rule may have no idea about how to ride a motorcycle or how a motorcycle works. He is just being chauffeured around in a luxury SUV given by the state on the tax payers money.




    8. If the ban on exhaust modification is based on permissible decibel levels stipulate 80 decibels and sound pollution levels then they should take an action against Ape or any other Auto Rickshaw which makes more heavy harsh noise than an an aftermarket motorcycle exhaust! Why is this not applicable to 3 wheeler's.




    9.The primary objective of the Police is to serve and protect not to catch modified motorcycles and fine hapless motorcyclists! What a priority!




    I think its high time that fellow riders react to this and file a PIL against this in the High Court or any other court of justice as an appeal against this order!

      I agree to your post in general but this point on your list is the root cause for such judgments. There is no minimum standard that aftermarket accessories should follow which in turn results in crude and crass products that is just too much of a nuisance. The RE silencers made by every tom, dick and harry for example. When I picked out something to replace the stock silencer on my Electra, I was sensitive enough to go for a sane sounding one. But there is no denying that there are idiots on the road who modify the bikes to make more "noise" and "stand out". Blinding white lights are another example. To an extent this can be curbed if we have some prescribed standards that the after market products must adhere to, though this will have no effect on the guys who just rip apart the motorcycles to make it look and sound "cool". And to that extent I can understand the thinking behind this decision.

      Setting standards for aftermarket parts could be the way forward, rather than a blanket ban on modifications. But implementing it is going to be a whole different ball game.

        @ Jai Nair - let me put in my thoughts as a fellow Keralaite. There is a trend catching up in Kerala with modified bullets. Rather than ride the damn machines, impressionable youth are in a race to mod every bit of the bike they can.

        Aux lights, wheel lights, ultra loud exhausts, and rash driving are all the craze now.
        Just because they are legal and you pay tax on it, doesn't mean you can plonk whatever you want on a road going motorcycle. There is a guy I know who doesn't care to replace his broken headlight, but wants to fix LEDs on the body of motorbike. When is the preening and the modding going to stop? Each guy wants to outdo the other, like the weirdos on the Jerry Springer show.

        There is a need of regulation of aftermarket fitments, thats for sure. Technically, every aftermarket fitment is illegal unless approved by the RTO.

        The govt collect taxes on kitchen knives too, but stabbing your neighbor with it is illegal.

        The govt collect taxes on salt, but that cop has no right to empty a packet of it in your tank.

        Acid is sold in the open market too, and you have a fundamental right to purchase, store and use it, but the govt doesn't let allow the application of it on the face of the girl who rejected your love proposal.

          Points jolted down are all logical in both the sense. Let me explain a bit from a rider and a poser point of view.

          Rider:
          1. Need better spare parts as compared to OEM spares. Examples - Oil from reputed companies like Shell, Motul, etc. to OEM oil like Yamalube, Honda oil, RE liquid gun, etc
          2. Need for enhancement of ergonomics like better seat, handle bar, etc.
          3. Performance spares like K&N, Muffler, etc.


          Poser:
          1. Need to stand out with lot of modification like LED lights, Loud muffler, Total structural change of the bike like cruiser type or scrambler.
          2. Not worried about the speed limit or rules. The more the speed the better the exposure.



          This gives a better understanding of the needs of the people. Now the police are mainly looking for posers but end up with the riders who are penalised for the not so determental modifications of the bikes.

          Like said police are using this rule to their advantage to get more moola out of this entire episode of bike modifications and we the poor riders are also penalised for the wrong doings of few posers who escape most of the time.

              What about a big bike with a slip on with a dB killer but the decibel level is lower than the permissable limit? Will the authorities still try n take your exhaust cause on the bigger bikes they are more expensive.
