  • Owner reluctant to sign on ownership transfer papers

    Hello everyone,
This is my first post. Always been a silent follower of the forum. Got a used KTM Duke 200 from OLX around 3 weeks ago. The ownership transfer didn't happen at that time because NOC of the bike was missing. The bike was on loan. I had paid the money for the bike through IMPS transfer to the account of the owner's brother.
I have received every document of bike from the owner and also the bike is in my possession. The NOC has also arrived for the bike recently, but I don't know for some reason he is now delaying and postponing the work for petty reasons. When asked what is the problem, he replied, if you don't trust me then you can return my bike. When asked about the money, if I return my bike then he doesn't say anything. I am at my wits end.
Kindly suggest what shall I do? Do I need to take any legal action?

You have to deal very carefully in these matters. You should not have taken the bike without papers. Contact a professional advocate and follow his instructions. Because in worst case scenario he can claim/complaint to police that you have stolen his bike as you don't have papers in your name.

If he is an youngster try talking to his parent.an unofficial visit by a known police constable to his house would solve things to most extent in india.

Try to solve by talks before taking any unnecessary steps to avoid additional cost as you have necessary documents with you.
