    NEW DELHI: Italian two-wheeler maker Lambretta Consortium today said it will seek claim of over ten million euros (about Rs 60 crore) from Scooters India Ltd following a favourable court order in Europe regarding their trademark infringement dispute.

    "Lambretta Consortium, the sole and exclusive owner and holder of the Lambretta trade name and trademarks, has today named Scooters India Limited (SCL) in connection with the unlawful licensing of Lambretta trademark rights in the European Union," the company said in a statement issued through Asianet.

    It said that the European Union Office of Harmonisation (Trademarks and Designs Department), has ruled that Lambretta Consortium hold the rights to use the Lambretta trade mark in automotive categories throughout Europe.

    SCL previously granted rights to a third party in Europe, it claimed, adding the dispute has lasted for nearly five years.

    "Lambretta Consortium has made a preliminary estimation on the damage originated by the unlawful licensing. The final claim is being expected to exceed EUR10 million," it said.

    The company said it is negotiating with Ajai Kumar, Chairman of the Board of SCL to explore options to find an amicable settlement.

    "Lambretta Consortium has stated that it will proceed with its claim if parties cannot enter into an agreement within due time," it added.

    When contacted SCL Director Finance, P Muthuswamy declined to comment.

    The government owns 95 per cent stake in SCL and it has been looking to revive the company by roping in private partners through part-sale of its stake.

    Companies like Mahindra & Mahindra and Atul Auto have been linked as possible suitors.

    In 1975, the Lucknow-based SCL had started its commercial production of scooters under the brand name of Vijai Super for domestic market and Lambretta for overseas market. The firm now makes only three-wheelers under the Vikram brand.

    As per the Asianet release, Scooters India had a net loss of Rs 22 crore.

          i dont understand. SCL website claims they are the sole owner of the name lambretta while the lambretta consortium claims its theirs.. so SCL is using the name illegally or what? did they get the name from the consortium but dint pay royalty or they used the same name by chance? and what is the GOI doing making automobiles? lol this is a unnecessary waste of money.
          Regardless, Life shall go on.
