  • Bajaj Vs. Volkswagen - The Logo War!

    MUMBAI: Bajaj Auto may have unintentionally violated German car giant Volkswagen's trademark VW logo as per a cautionary notice recently made public.

    Auto major Volkswagen came to India just 18 months ago but its history and logo began in 1938 with cars that targetted the masses. Volkswagen's logo is recognised worldwide as its primary identification, no suprise then that its venture in India comes with a trademark notice to protect the iconic trademark and goodwill.

    The notice says Bajaj's newly revamped logo bears a striking similarity to Volkswagen's trademark VW logo. In fact, the logos are so similar that lawyers say even if it is an error or an inadvertent move on the part of Bajaj, the rendition falls under deceptive similarity, a common contention in trademark violations.

    Officials with Bajaj Auto declined to comment on the matter. Volkswagen officials in Germany, when contacted, also declined comment but those familiar with intellectual property rights (IPR) norms say volkswagen has the advantage of 'transborder reputation' - a label that puts its logo in the class of trademarks easily noticeable across the world.

    Bajaj Auto, on the other hand, was set up in 1945 and has the advantage of being in business for 60 years and enjoys a reputation of quality on its own standing. It can also claim product differentiation by virtue of being a two-wheeler operator although it is venturing into small cars along with Nissan-Renault.

    If the matter does reach the court, the likely test will fall on whether the common man can distinguish between and/or recognise differences between the logos. Regardless of the outcome, it is likely that Bajaj may have to modify its logo in the long term.

      does the VW think that all the Indians are familiar with their company and their company logo? and yeah common people can differentiaite between bajaj's logo and the (unfamiliar) VW logo

          Well, I am one among the people who felt that the Bajaj's new logo has a striking resemblance with the VW one... I felt this way when I saw the Bajaj logo from certain angles...

          Also, if u flip the Bajaj logo 90 degrees to the right, you can see the letters V & W.



          Now, in an IPR case you cannot go ahead and argue that these logos are very different because of the following three points:

          The angle of display, VW logo being encircled, small gap separating the letters V & W.

          Also, I believe, most Indians relate to Bajaj with this logo than the newer one:


          After all, we grew up seeing this logo every day and the new one is just a couple of years old!

          Well, this logo image is small but I am sure everyone knows what I want to refer to.

              your company logo is your identity... as much as one persons face is to him.

              Now you cannot go ahead and make a logo for your company that is very close to another one in the same industry, has been identified as an iconic brand for over 80 years and identified by most people uniformly throughout the world... may be the VW logo can be distinctly identified by most people around the world --- if you have to give them a standard list of say 10-15 logos.

                Boring! God.. where's the similarity... Playing on that logic, we could use Pshops skew tool and make Honda into Hyundai.. Why are corporations even bothered with silly things like these?

                    Because a brand is extremely important .. case in point Zipper and Xerox. Zipper is actually a brand/company that manufactured fasteners but as the product became synonymous with the brand name, ppl forgot that zipper was a brand and eventually every TDH was calling their product a zipper. In the same way not a lot of ppl know that Xerox is actually a company and not the product (photocopier).

                      that's not a strong case against Bajaj Auto I think. In identity and logo designing even a single line or dot changes the whole layout. There's rule in standard copyright act as well that if you modify an existing picture/identity/ or any f**king thing by 60%, its become yours legally, though very debatable.

                      A simple example is here. The logos of Metros around the world. So very similar yet so distinct.

                        Now, that the issue has been raised we can start identifying the similarities between the two logos. Else, who every thought of Bajaj logo as VW's? I mean I never looked at it like that. I still wonder why Bajaj changed its old logo. It was very good felt complete. This one looks like naked one flying in air .

                            Yes they do look similar but from totally different angles!!!! Bajaj should fight strongly against it! How many in India knows VW & how many outside India, barring few countries know Bajaj?
