    Mahindra Two Wheelers Ltd was recently directed by a District Consumer Forum to pay the complainant Rs 64000 as compensation for selling him a defective motorcycle.



    This comes close on the heels of HMSI being directed to pay a fine for similar reasons.

    The East District Consumer Disputes Redressal Forum, New Delhi, held that the Mahindra Stallio that was bought by the complainant had a manufacturing defect.

    A bench presided by N A Zaidi -

    "Counsel for respondent (Mahindra) could not satisfy this forum how in a short period of four months the engine will
    require a major overhauling and replacement of vital parts...
    "We have no hesitation in holding that the motorcycle in question was suffering from manufacturing defect. The various job sheet confirms that complainant was put to harassment due to defect in the motorcycle,"
    The cost of the motorcycle is Rs 49000 and Rs 15000 as compensation for harassment.

      Such news should spread to create awareness among the consumers, about their rights. I Know a person, who got a RE 350 classic with defective/broken engine head. He kept complaining from day 1 about somthing is not right, but the ASS didnt listned. They said, its going to be alright. It eventually broke down after 6 months of head ache, and he had to pay Rs. 5000 for a new engine(I dont know, what was the charge for, as all should have been covered under warranty.). Such people dont know about such laws and hence get cheated, both by manufacturers and dealer equally.

        Well....my 200NS also got its Crank changed after just months...may be I too couldv gone for this :P

          This is just one perk of a grain of a pot full of grains that are unsung. This is one of the best ways to create awareness. If it has wheels, it's supposed to get defective, that's one. But niggling from day one is a big no no and hope this serves as an eye opener for the producer and the consumer.

            Hi Sam. Its never to late the person you are referring to can still launch a complain with consumer forum. As the dealer must have given the repair receipt with the date mentioned 6months later from the invoice of purchase. The company have to bear all the cost and might refund the extra money paid for engine.
