  • Thane: Two-wheeler Co asked to pay Rs 50,000 for deficient service

    Thane: A consumer forum has ordered a motorcycle manufacturing company to pay Rs 50,000 compensation to a customer for deficient services. Monesh Mishra, a resident of Vasai town in Thane district, had complained to District Consumer Redressal Forum that on May 5, 2011, his two-wheeler met with an accident as a result of which it needed repairs. The next day, he gave it for repairs to the service centre of the company.
    However, the service centre did not carry out the repairs for about three months, saying the spare parts were not available. Hence, the complainant said he had incurred business losses as there was deliberate delay on the part of the company to repair the vehicle.
    The complainant claimed an amount of Rs 1.80 lakhs towards business losses, Rs 1,000 as compensation per day from May 6, 2011, towards mental and physical suffering, and Rs one lakh towards legal expenses. Forum president Umesh Jhavalikar and member ND Kadam, in their order last week, observed that the company was expected to repair the two-wheeler, which was given to it for repairs on May 6, 2011, within a reasonable period of time.

    However, the period of four months taken by the company for repairing the vehicle was not only indicating indifference but also inefficiency. The bills for repairs produced by the complainant showed that the repair charges were just Rs 5,000, hence the repair to the vehicle was minor and simple and expected to be done within one month and the vehicle should have been handed over to the complainant.
    However, the respondent company took four months for the repairs and caused discomfort to the complainant and hence there are lapses in the providing services to the customer, the forum held. The forum ordered the respondents Honda Motor Cycles and Scooter India Private Limited, at Alwar in Rajasthan, its unit at Pune and the service centre, Aditya Honda Motors at Vasai, to jointly and severally pay Rs 50,000 compensation to the complainant within 60 days of the order.

      A very high sense of complacency is shown by HMSI in the service dept. They now seem to take the Indian customer for granted. Seems as if they feel that this will not affect the brisk business that they do in our country. However, complacent manufacturers have almost always been shown the door by the indian customers after a time. Even RE was forced to revamp to battle competition and retain customer base.

      Hope this shakes things up a bit.

          Yes. Justice delayed is justice denied.
          Still, I think some of the Bike manufacturers need some tight slaps like this. They have taken their customers for granted. They have two different avatars; one pre-sales and one post-sales. And cudos to the complainant for persisting with his rights for 3 long years!

            My experience with HMSI was equally pathetic with the official dealer in PCMC, Pune. Once they did not even bother to service the bike despite keeping it with them for 2 days and me indicating that there were some mechanical faults that I wanted repaired.

            I shot an email to HMSI through thier contact us page on the site and my bike situation was rectified within a day. HMSI cares about its customers. The local dealer doesn't.

              In mulund(Mumbai) two vehicles were missing from the premise of the service centre couple of years ago,They ride the bike for lunch and ride rough
              I have seen this,its sad that the managers dont say anything.

                  This is the same at almost every ASC.. be it service, spares , customer service. they wash their hands off once the bike is sold, and come up with various stories to avoid doing the necessary work. worst than some of the govt services if you ask me. if only obtaining justice was easier..at least for such consumer issues.. I just read a news article that Jet airways was asked to pay 2lakhs to a consumer for a delayed flight in 2007..
                  Somebody needs to sue the courts for delaying judgements

                      Just goes to show how pathetic is the so called customer service and equally pathetic how the courts function and rulings they take. They are stuck in stone age and resist to move ahead with times. I bet the 50k didn't even cover his legal cost, so you will lose even if you win in this country.
