  • Karnataka HC quashes State RTO Order for outside registered vehicles

    The Karnataka High Court has declared the law that forced vehicles with outside registration to pay tax within 30 days as unconstitutional.

    The Karnataka Government had earlier made a law which ensured that a person who stayed in the state with a vehicle registered in another state for more than 30 days would have to pay lifetime tax in Karnataka again.

    This law has been used for some time now to harass people from outside states with vehicles registered in other states. This ruling by the Karnataka HC will make life easier for many people who are working in the state, especially in the capital city of Bangalore.

    Justice Anand Byrareddy quashed the demand notices issued by the RTOs to owners.

      You do pay taxes. But to the home state.

      11 months is the standard across the country, i would assume it would now be the same for Karnataka as well. But you will have to crosscheck that information.

          Yes they might continue to do that. The best bet is to keep an attested copy of the judgement note(which will be available soon) with you always and stick it to their throat.
          I wish the Karnataka police and RTO were like the rest of the Karnataka people.

              This is welcome but still according to the law one has to pay tax in the state where the vehicle is used. This whole problem arises because of the liefetime tax for every registration which is difficult to say the least to transfer. If they change the vehicle tax period to every year or every two years then people can just pay the tax where they use it and we will have no such issues.

                That ll end up like insurance. Most people wont pay and bribe the cops. RTO will financially go down and so they ll never do that. :P

                  It is in US like that. They pay taxes annually. At least in some states.

                    That's one reason why the rto fines outstation vehicles. People abusing and circumventing the law are dime a dozen .. don't be one.

                    I remember back in the 90's quiet a few cars in chennai ran with PY (pondicherry) registration. I was a kid back then so did not know about all the taxes n stuff.
                    When i asked a driver of my cousins why some cars had 'py' , he told me that cars were significantly cheaper in pondy and so some folks buy it there.
                    Later on the rules were tightened and slowly the PY vehicles vanished from the roads.

                    There is provision to claim refund of the tax paid from the current registered state, that way you do not end up paying double tax.
                    Though the process might be frustrating (govt offices eh.. you know the reasons) so not many know or opt for a refund.

                      That's exactly my point.
                      People all over Karnataka including villages pay lifetime road tax* while we from other states get to keep our out of state vehicles longer.

                      I guess RTOs should give an online/offline-payment provision for monthly, quaterly, half-yearly, yearly road taxes.
