    Automobile companies that don't recall vehicles despite having clear evidence of safety defects may face penalties starting October 1, according to rules in the making. Also on the cards is a government-appointed nodal agency that could launch its own investigation into safety issues and even recommend the government to order a recall.

      About time. We are one of the very few countries where the law does not provide for a stringent mandatory recall policy.

      How the law works here is in the event a defect is identified the company is asked to make a voluntary recall. If the company fails to do so the only option the government has is to file a suit before the local courts which could stretch on for years before a definitive verdict or action is reached.

        Yep. Just another agency to make money. Manufacturers will bribe them, they keep quiet, govt makes money but people will gain nothing.

          if people make noise where it's required, a lot will improve.
          if the consumer wants to sit behind a monitor and whine, then they will make merry.

            A government appointed nodal agency is the only way forward. The current scenario is horrific considering we are one of the top 10 automotive markets in terms of volumes of four wheelers and two wheelers and yet we have no recall policy.

            Every single major automotive market in the world has a product recall policy and its good that we will too. Like I mentioned above, the scenario today is that you either take the manufacturer to court and let the matter rust for years or you hope the manufacturer does a voluntary recall.

              Yes because people who make noise by parading their lemon cars with donkeys or people who are sitting with cases against manufacturers pending in the consumer court for ages have dented the manufacturers sales charts in this country isn't it?

              Just last week, the RTO lost my license that they had confiscated a long time ago and I had to go to the lawyer to get it back from them the very next day. They refused to search for it until they saw the legal notice.

              Anytime you bring in the govt to play the referee, the people lose especially when manufacturers have the "I give you the jobs and your economy, you bow down to me" trump card.

              Easy to sit behind a monitor and pass silly remarks when the ground reality is anything but that simple.

                By your own example, you see what happens when the consumer starts standing up (in your own case, it was a mere notice i.e. a written piece of document.. not a lengthy case)
                My previous reply wasn't targeted at you specifically but a generalization of whats happening.
                I have taken up plenty of issues with the authorities (including nodal officers), and I know the magic that can happen if one puts things in writing thru the right channel.
                These days a lot of services (e.g. banking, consumer goods etc..) all have an email address and customer care contact info displayed on the product.. if a consumer takes a bit of time to jot down his grievance and shoot it across to the concerned and follow up, a lot of issues are resolved, and trust me the effort is not much (i haven't had to go to a lawyer or send a 'legal' notice.. just a few emails, followed by calls at times)
                The folks i've dealt with include govt banks,mobile service providers,isp's, fmcg,automotive,shops(mrp), hotel's.. etc.
                I agree govt folks are difficult to deal with, but remember this case is more of a private segment that is going to be watched by a govt agency.. so get your pens and keyboards out and start writing to the both the parties.
                Let's simply not shove it under the carpet even before its implemented! And unless a consumer starts putting his foot down, nothing will change.. and remember change is slow and doesn't happen overnight.
