    TVS Motors has filed a civil case in Madras High Court against Bajaj Auto for making a misleading claim about TVS XL100ís fuel economy.

    TVS Motors has claimed that Bajaj dealers in Tamil Nadu have circulated false information comparing TVS XL100ís fuel economy with Bajajís entry level bike CT100.

    The Madras High Court has granted TVS Motor a temporary injunction against Bajaj. The court has given Bajaj two weeks to file a detailed response and temporarily restrained it from continuing with its advertisements for that period.

    As per the advertisement, TVS XL100 gives a fuel economy figure which is less than 50% of what the Bajaj CT100 extracts.

    Bajaj said, its campaign comparing TVS XL moped and CT100 was based on real-life mileage numbers taken from customers
    Eric Vas, President Ė Motorycles, Bajaj Auto, said:
    ďWhen the matter comes up, we will submit that the advertisements were neither disparaging nor denigrating TVSí product(s) but were merely a reflection of the customer experience, as disclosed to us.Ē
    In 2008, the two companies fought a legal battle over patent violation with Bajaj accusing TVS for copying its patented DTSi technology. That particular case ended in TVS favour in 2009.

    TVS in their hometoown..is bound to win the case....Tamilians are hardcore fans of TVS...like they are for Rajini...no matter what TVS sells they will buy...Bad tactics BAJAJ

    Nope. Not all are hardcore fans of TVS and not all are fans for Rajini. They have their own fan circle and hate circle alike. And there are people who buy TVS for its utility and price point. There are about 5 Scooty peps in and around our extended family and an XL. But there are also bikes from other manufacturers as well. I myself own a Yamaha. As far as I know, there is no competitor for TVS XL and Bajaj should have avoided comparing XL with CT100 which only brings down CT100's image to a moped.

    That said, I di really wanted to have one (XL 100) when I became aware of its presence last week when I heard an XL sounding like a 4 stroke in the traffic and forgot about it soon, until I started to look for a scooter for my wife. She does not like it. I may buy it for its practicality in Chennai traffic only if it had button start and a tacho.

    I really expected an upgraded SS125 from Yamaha with a refined engine. Perhaps, some thing like Y125, if that would not be wishing too much. But sadly they dumbed it down to 4 gears and no disc brakes and called it Saluto

    I somehow feel that instead of giving mileage figures on their own, companies should adhere to ARAI figures. ARAI figures are more or less accepted by all parties involved. This type of unfortunate allegations and counter-allegations are not good for the industry.

    If this is the case then each and every manufacturer can drag each other to court as all the dealers try to make a false statement against their competitor.

    TVS Motors dispute with Bajaj Auto over disparaging ad campaign of claiming false fuel economy of TVS XL100ís against Bajajís entry level bike CT100 has comes to an end in the Madras High Court.

    Bajaj Auto has withdrawn the said Ad Campaign and submitted a memo in Madras High Court for the same. The court has taken the memo into file and issued an order.

    In July last month, TVS Motors had filed a civil case in Madras High Court against Bajaj Auto for making a misleading claim about TVS XL100ís fuel economy. The Madras High Court had also granted TVS Motor a temporary injunction against Bajaj and asked the Pune based motorcycle maker to file a detailed response within two weeks and temporarily restrained them from continuing with its advertisements for that period.

    TVS Motors has now sought a permanent injunction from Madras High Court restraining Bajaj Auto and other two-wheeler manufacturers for continuing any such advertisement which allegedly disparages the TVS Motor's product TVS XL 100 by comparing the fuel efficiency on the basis of false figures.

    TVS Motor had also sought the court to direct Bajaj Auto to compensate Rs 25 lakh because of unfair trade practice adopted by them.

    According to the memo submitted by Bajaj Auto, the company has withdrawn the comparative ad campaign and also agreed not to reintroduce any such advertisement either by itself or through its dealers.

    An order issued by Justice Pushpa Sathyanarayana said,
    "Accordingly, the memo is taken on file and the suit is decreed in terms of the memo dated August 8, 2016, filed on behalf of the defendants (Bajaj Auto). The memo shall form part of the decree. No costs."

    As i said in my earlier post TVS will win the case because its in their backyard....wrong move..no way they could have won the case...And this is not about Bajaj every company does this no matter how big they are. Look at Volkswagen fiasco.
