  • Motorists using earphones gets you jail term in Hyderabad

*"Driving with your ears plugged can get you arrested. The Hyderabad traffic police has started booking commuters caught using earphones or headphones while driving under Section 184 of the Motor Vehicles Act.

Instead of simply imposing fines, the police is filing chargesheets against offenders and detaining their vehicles.

Vehicles will be released only after the offenders complete a jail term and undergo counselling.

About 192 cases have been booked so far this month, of which six offenders are put behind bars."

In car, with factory fitted music system, one can make calls over bluetooth and keep listening to music as long as he likes and sit in car, he can use navigation maps and others on car infotainment system.
But A sales person on a two wheeler is not allowed to use ear phones. He might not be listening to music but might keep it plugged, in case he receives a call.

I am not sure what they are trying to achieve with this. Would love if they publicly share the challans data on whom they are fining more. I would like to see RTC buses, Luxury cars, Lorrys and Auto walah's count.

I feel recently there is a tremendous amount of people who have started wearing helmets due to fines and awareness. So the cops might be losing revenue(cough:bribe) because of this. So they had to come up with this ridiculous move!

More dangerous are pedestrians who use earphones at full blast and cross junctions and railway crossings without even looking both ways causing panic braking for motorists. Even then we have keep our eyes wide open to clear them otherwise we will be jailed for pedestrians stupidity.

No offense to anyone but I personally think that this is an welcome move and should be implemented in every state. Riding a two wheeler has risk quotient on the higher side. I feel frightened when I see 16/17 year old 'bikers' plugging in an earphone and riding recklessly oblivious to the surroundings and any sounds.
And any law has one common challenge - implementation.

There's a difference between using earphones and a car's inbuilt audio system. An earphone cuts off the outside noise to a big margin, specially those "in ear" ones, making them unsafe. Car owners can still hear most of the noise outside.
You're right about the in-car navigation systems though.

For salespersons, I can suggest using phones with good vibration levels. Or they can use a phone with a very loud loudspeaker (like the Mi A1 for example) and in the upper pocket, a person can surely hear the ringtone.

I'm in support of the move, largely speaking. Because I see so many youngsters riding with earphones on.EDIT: On a second thought, I think jail term is a bit too extreme.

And as for us bikers, we can use Bluetooth enabled helmet kits. They're in helmet, so no one would notice that.
Although, biker or not, I definitely don't recommend it for listening to music.

My concern is no way related to the Move.
I am asking, where is the Equality.
RTC buses can carry any number of people. If private bus does that, heavy fines.
We all know our auto's condition and what fuel they run on. How many of them are fined. But if you go on a bike without helmet, your balls would be rattling. Where is the equality. Where is the law?
If you go in a fortuner. No police man will stop you. If you go in an alto fastly or at same speed as fortuner. You would be put in jail.

That's why I said, "largely speaking" in my last post. Of course, a whole lot of stuff is not right and will not go right.

Direction is right, even if not equal.

I'm concerned precisely about this part. I guess it would too much to expect from cops to differenciate between bluetooth helmet kits and normal headphones. And once they see the unit on the helmet, it won't go un-noticed. Given the level of knowlege of our cops it would be hard to convince and get away.

Traffic offences should have fines. Not jail terms. Unless you mow down a bunch of people sleeping on a footpath!

We aren't living in a police state (yet)!

Hmm.... right, fines should be enough.
I guess a jail term is just extremism...

A bluetooth kit is mostly fitted inside the helmet. Most imported helmets come with sleeves near the ear place, to accomodate these kits... So, these kits are normally not visible from outside. One such example is this: youtube(dot)com/watch?v=I73PRPhwL-M

Nevertheless, your concern is right. I hope riders don't fall for the temptation to listen to music.

I live in Rajasthan, I don't have this problem here, traffic cops only care for helmets even if they are the $2 roadside helmets.

BTW I had modified my LS2 helmet 3 years back, I had put a (over the ear) headphone with a bluetooth receiver inside it in such a way that nobody can detect the headphones or the bluetooth device while I am wearing the helmet. I put the headphones behind the helmet's cushion, so it didn't cut off the traffic noise, on the contrary music was not as loud and enjoyable due to outside noise. I hardly use it since I don't have to drive for for more 10 minutes in my small city. I use it on the highway for navigation and music.

That can be a viable solution for anyone who absolutely needs to talk on phone while riding. It wasn't expensive either, panasonic headphones of Rs.500 and a local bluetooth device (Teconica Bluetooth V4.1 Headsets Handsfree) If you guys are interested, I will make a DIY post.

This is a stupid move and has nothing to do with imposing any safety standard but purely to make the cash deficiency in check.
I hope this law bites the dust same as the Banglore's helmet crap did last month.

And whoever is saying this is a welcome move, please sign a petition to ban music players from personal cars and SUVs as well, no excuse on how much or less this is different.

                              Regards.
