    Supreme Court allows sale of BS4 vehicles, but with a world of twists!

    The Situation: April 1, 2020 was the scheduled date for BS6 compliance compulsion for every new bike and car sold in India. SC had to face an appeal towards shifting this deadline, due to Coronavirus, many showrooms remained closed.
    As many as 15000 passenger cars, 12000 commercial vehicles and 7 lakh two-wheelers, all of which are not BS6 compliant, remain unsold.

    A public survey by 91wheels (of 360 people) showed that 78% of people voted for shifting of the 1st April deadline. Means, they support sale of BS4 vehicle after 1st April.

    The UPDATE:

    The Supreme Court has finally allowed the sale of BS4 cars and bikes to resume even post 1st April 2020 but there are a lot of conditions. The very first update clarifies the following:-

    1. The first thing that is clear is that the sale of BS4 vehicles will not take place in Delhi NCR, after 1 April. It means, Delhi owners are out of luck if they wanted a BS4 model of their favourite vehicle.

    2. Supreme Court has allowed the sale of only 10% of the current stock of BS4 vehicles. This is very harsh in our opinion as due to a complete lockdown, no showroom was operational since the past few days.
    In other words, 90% of the new car sales will have to be of the BS6 compliant ones as per news coming in. Most manufacturers in India have updated their entire range to comply with BS6 emission norms.
    It means, if they sell 9 BS6 vehicles, they'll be able to sell 1 BS4 vehicle after the deadline, for a limited period.

    3. The registration of the BS4 vehicles will have to done within 10 days of purchase.

    We are still not clear on the timeline of this as India will remain in a lockdown state till the 14th April.

    UPDATE 2: Sale of BS4 cars and bikes will be allowed from 15th till the 24th of April (a period of 10 days).

    I am one of the few lucky/unlucky ones making a purchase in late March.
    I came across a Honda CB300R in Gurgaon showroom which was the only piece left other than 1 Gold Wing and 1 Africa Twin. Without losing much time I made the full payment and was making plans to take it to Uttarakhand (my state) for registration but then this Junta Curfew followed by 21 day lockdown was announced and now I don't know if this was a flying arrow (Udta Teer).

    Although the dealer is reassuring that he would help me get it registered but the SC doesn't look very forgiving on BS4 vehicles.
    When it is not even clear that the lockdown wont be extended beyond 21 days.

      I am keen on what will happen to the remaining engines and drivetrains of these Bs4 vehicles, as India doesnt yet have a proper scrappage policy and manufacturers would not take this as a loss. They might try to sell in parts or usage as experimental or workshop learning equipment...

        Bhai, this is udta teer only, thing ia since they say registration wil be open, you will be able to register the vehicle, just make sure to press upon the showroom guy.

          Yea.
          But for that interstate borders and the RTO should open for public.
          And also the lockdown should be lifted.
          But we don't know how things will turn in these remaining days, if things go south then SC might go back to their original stand.

            Well, if I know a little about India, I would say, be in constant touch with them, keep following up, and you can get it done (provided that this Delhi NCR rule is removed or something, by a re appeal).
            Otherwise, best bet would be to ask for a refund of your money, or get a BS6 model.

            But yes, for majority of vehicles, it makes more sense going for BS4 for now, speaking technically only, not legally or practically.

              The most obvious solution will be to export the older BS4 stock since scrapping is not an option. Also, just like they did at the time of BS3 deadline, dealers will register the BS4 cars/bikes in their name and sell it to you at a lower cost later (the only downside being you'll be the second owner).

                I read about the Delhi rule.
                With the number of cases rising quickly I don't think Delhi will be getting much relief anytime soon.
                U.P. should be lifting the lockdown on 15th as per news reports so I'm preparing to take the bike to U.K. for permanent registration.
                Waiting for BS6 would be too late imo with COVID19 crisis worldwide.
