There is nothing to clear out, honestly. There is no such law regarding action cams. We , most of us here have already done the research and googling around.

Or are you scared of cops, I have action cam everyday with me, most of the times on helmet, for the past 3years now. One has to educate the cops if they come up with these stupid acts.

I didn't argue with him much as there were a minimum of 15 cops and I look too young for a 22yo. xD
I will be still going to the nearest traffic division and clear this out.

Under IT Act??? Under which section? You have a cellphone, google the act and show it to him and ask him to point out under which section this rule is laid out.

There a lots of instances where just because a government official says it's not legal does not make it so.

First of all, its clear they could not understand your ques, which was imo was in simplest of language.
Also if someone ask me to "dawn lode", I am sure he would have no idea what actions cams are.

So you have a chill pill, use your camera with full freedom.

But atleast here in Delhi NCR, I have never been stopped, even while touring in the mountains police was quite happy to see us with that much gears and camera

Still waiting for the next reply.
I seriously don't understand what is wrong with this cops.
Some encourage me and tell me that it is a good thing and this cop who caught me (was with 10-15 other cops, 3 star and everyone, a.k.a Naka-bandi) was so damn sure that it is not allowed.

If you have seen mine cool cop video (Prat The Brat) then you can see how cool are the cops if you explain them the use of it.
There is no IT Act, he simply wanted to churn out money.

And next time they stop you, alongwith your normal designation intro, also tell them you are from media and you make videos. They will take it little seriously.

First of all the thread goes back to 2014.
We all know the new rules and fine charges that have been changed by RTO in the past 1 year.
They've changed it like 2-3 times.
Now this cop specifically Quoted "According to the IT ACT it is not allowed".
He asked me to turn it off and I did not but still somehow he let me go.
This is why I asked the question again.

First off, did you go through the thread? Please do. Now, coming to your query: No, it is not illegal to use cameras with recording features on vehicle. Yes, it is illegal to photograph or record defense & sensitive institutions. However, such places have clearly marked zones and warnings for restrictions.

The fact that the cop is not quoting you the exact law/rule under which he claims such restrictions as a general rule should have alerted you that he talking off his hat. It is the cop's job to quote the exact sections of the rule book while enforcing the rules. Never noticed it? Look at every traffic challah you have been issued; it will quote the exact section under which you are being fined. Never be shy to ask what rule & section you are being asked to do something. Don't be impolite or aggressive, but ask for clarification, it's your right.

Place: Mumbai, Mulund Toll Naka.
So recently I was pulled over by a cop who asked me about my camera, asked it's price and what it does, then tells me that its good and lets me go away.
45 minutes later another cop pulls me over (There were like 15-20 cops over there for checking)
Now this one asks me for my driving licence and then he starts talking about my camera.
He asks me is it Legal to mount a camera and record on the road?
I was confused and didn't know what to say, so I honestly told him that he was the literally the first cop to ask me this question.
A lot of cops see me but they never stop.
I'm always in perfect riding gear with the camera.
I have a channel on YouTube named Piston Head and I upload videos.
Now this cop won't let me go as he keeps fixating that it is ILLEGAL to mount a camera on the helmet and RECORD.
He was young and he said that most of the cops don't know about all these rules and he does, he asked me to turn if off but I DID NOT. As I was too skeptical that he probably won't let me go after I turn it off.
I seriously don't know about this rule and want to know from you people if you know ANYTHING related to this ans can be helpful to me.
I do take people's permission before using a footage in which they are seen.
Can you all please help me with this?

The two lines that you quoted explicitly say I didn't. But I went back and checked again all my posts and still only came to the conclusion that I didn't.

But I'll say it again "its NOT illegal". And honestly how is the cop in trouble if he erases the contents of your memory card? He pretty much deleted the only proof of his guilt. And let me tell you that you're word over that cop's is not admissible in court as evidence.

Well............. Could be. I mean as I said in my post I'm not a lawyer so I'm not up to date on the law.
POTA was repealed as you said (I checked after reading your post) but the apparently temperary laws and rules they made for god knows what reason still hold water. I think it might be because cops don't like media attention. Whatever the case maybe, I attached a couple of articles into my post which give actual standing laws on public photography in India

either way... you cannot be legally prosecuted if you're riding on public roads and have a GoPro mounted on your helmet.

and... if a cop deletes the content of your memory card... well then, let's just say that legally, that cop is in much bigger trouble than the wearer of the GoPro.
