    Hi Members,

    For past few months there was constant checking by Police Officials in my area. The checking included Helmet, and sometimes Registration Documents and Insurance papers. Today, a police man got killed when a biker hit him hard with his bike. I would like to know more about out country's laws with these cases and checking.

    1. Is it mandatory to have all the documents while driving a vehicle (car or bike)? Please specify what documents are supposed to be carried around?

    2. If the driver has just the driving license and is wearing a helmet how much does he need to shell as fine?

    3. If a police man stops the driver and gets hurt/killed in the attempt, how does the government takes it.

    4. Is it mandatory to have insurance while driving in India?

    5. If a vehicle doesn't have insurance how much fine is charged?

    6. Is State Police authorized to check helmet/documents etc from commuters?

    7. What is the importance of Traffic Police if State Police can do all this work?

    8. For checking of this sort who gives the orders?


    I should mention that people in my locality are fed up with this checking. Even wearing a helmet and driving with responsibility once I was caught and was asked for "Documents" when I forwarded the License and RC book I was asked for Insurance, and since I didn't have insurance on my bike I was asked to pay fine of Rs100. When I paid it I asked him to write that you have taken this money because I didn't have insurance, but the police wala said don't ask so much else you will have to pay Rs.1000 for not having insurance. I was pissed and got out of there as neither I'm a powerful person nor do I know anything so there was only my loss if I might have argued with him in INDIA.

          Ok for ppl who asked questions, u get all these answers when u apply for license you can clarify and i am sure some traffic police site has it mentioned, well anyways.

          Ans: you need to have Bike/car Registration Certificate (RC), Valid Insurance and Driving License (or smart card with all the info) without License and insurance you are as good as a murderer in a race car.


          2. If the driver has just the driving license and is wearing a helmet how much does he need to shell as fine?

          Ans: The fine varies from State to state as these rulings are defined by state traffic police or high court until challanged, in most cases bike would be impounded and can be registered as stolen. If bike papers are not on your name they should be either on your fathers name as on license or you should have NOC from the last owner.

          3. If a police man stops the driver and gets hurt/killed in the attempt, how does the government takes it.

          Ans: What do u think? Obviously get arrested and ready for trial.

          4. Is it mandatory to have insurance while driving in India?

          Ans: Yes!

          5. If a vehicle doesn't have insurance how much fine is charged?

          Ans: list of various fines in karanataka Bangalore City Traffic Police

          ideally it should be a court fine where judge decides.


          6. Is State Police authorized to check helmet/documents etc from commuters?

          Ans: No only Traffic Cops that too above the level of constable. If you mean regular state police just ask them for challan they do not have book and cannot fine you simple!

          7. What is the importance of Traffic Police if State Police can do all this work?

          Ans: Already mentioned in question 6, more or less irrelevant question, you answered it yourself

          8. For checking of this sort who gives the orders?
          Ans: generally by traffic commissioner or court you can see stamp on your challan. Sometimes state govt give orders to commissioner for a check

              Except the driving license,you can keep the xerox copy of the insurance,PUC,and RC attested by a gazetted officer with you instead of the originals.

                To avoid the cops, It is compulsory to carry all the documents (DL, RC, Insurance, PUC) and wear a helmet while riding the bike at all times. In addition to this, your bike should have a proper number plate i.e number in black on white number plate written in bold letters. Obey all the traffic rules. After this, even if the cops stop you, they will check all the documents and leave you. Don't try to escape if the cop tries to stop you, it will make matters worse.

                  hmmm are you sure we need to attest it ??? because I have been carrying only the photocopies and not the originals ... have been stopped a few times but they seem to be ok with the copies itself without any attestation ...

                    ^^ Depends upon the state. In Assam, they will straightaway tell you the photocopies are invalid. Attested copies, they will reluctantly accept.

                      Yes it is, you are supposed to carry Registration certificate, Tax certificate(generally mentioned in the RC itself)

                      Depends, the person might to charged with causing death by negligence, or even culapble homicide not amounting to murder or relevant sections of the Motor Vehicles act.

                      YES, Dont even think of using your vehicle without Insurance, You are required to posses atleast 3rd party insurance. Its not just legal requirement but also saves you from financial burden of compensation.

                      Traffic Police is force made to take care of traffic and implementation of the Motor Laws in India. Due to lack of enough man power in Traffic police, state police constables, Home guards and officers are also deputed.

                      That also varies, In city the generally the DCP or ACP of Zone/Traffic generally give orders in this regard. In case of checking for stolen vehicles the control room or even the SHO's orders checking of document or suspect vehicles.

                      Go to the CP or SSP's office and file an RTI application, Prepare a question pay Rs 10 and wait for 30 days see what they reply

                      Firstly, make sure you have every document metioned above. Secondly You have to know little more about the fines, it helps you a lot. If the cop fines you make sure that you get proper receipt and pay it. If you think he has charged you for an offence which you didnt do, file another RTI. Dont leave these guys.

                        As mentioned always carry:
                        • Driving License

                        • Registration Certificate(In case you have brought it from someone else and haven't transferred it in your name get a NOC from the owner and his address proof)
                        • Valid insurance certificate
                        • Pollution Under Control Certificate

                        About the photocopy thing I am not sure, in Delhi Once my friend showed photocopy of the papers and the answer came that this is not legal, you need to have the original papers. Its better to avoid cops as they would always cook up some law or the other..

                          Play safe and get it attested. You might have to carry the original PUC.

                            Hey, what's the deal with Bangalore cops? I've heard they stop you just because your licence plates are not bearing the letters KA. What needs to be done for getting my JH registered bike there and run without inviting trouble? I am going there for just three months.

                              You HAVE to carry the original PUC with you everytime, no excuse or else straight fine of Rs 1000.

                              Bangalore is troublesome in this respect, dont worry as pe the law you are allowed to use your outstation vehicle for 6 months without paying road tax in that state. You have to prove that you havent crossed that stipulated 6 month time. I suggest you to:

                              -Get a PUC done just before leaving Jamshedpur.
                              -Keep the last Fuel Bill intact(with your Bike registration number) prepared some time before you leave.I possible get 2-3 fuel bills later by post to show that you are new to the city.

                              and also if you have any other document which proves that you arent a resident of the city say for eg a letter from the company/university which states that you are in Bangalore for just 3 months and if possible the date also.

                              and also dont forget to pray everytime you see cops.
