  • Change of bore and piston in 2.5 month/6000Km old bike

    Hi guys,

    I got myself a Apache 180 ABS 2.5 month back. After my 3rd service, it is found out that the bore and piston are gone coz the oil seal used for maintaining engine oil was gone.
    Though they are gonna replace all under warranty. I want to know what if this problem occured due to a manufacturing defect?? Then is it possible that I can demand replacement with a new bike or take it forward to consumer court?
    Please suggest me with the best option that I have....

      as per what i understand from your post, the company is willing to replace all the damaged parts under warranty and fix your bike totally, ( i read this as free of cost ). So as per their legal obligations towards you they are fixing it, so you can't ask for a new bike by any provision of the law.

      If you really are interested (includes: lots of free time, money to spend) then you can file a law suits on grounds that it as cause discomfort to you due to their negligence (here again your claims are void if they fix it in a reasonable period of time). it's a long shot though

      hope i was clear enough, let me know if you need more clarity

      @mods: i think it would be a good idea to start a legal issues thread.

        vrakchu, if TVS is offering to replace the cylinder and bore promptly at no cost to you, it will be difficult to ask for a new bike..

        however, you can can ask for a complete dismantling of the engine, getting it inspected by a third party for any damages and claim for replacements of all defective parts. but getting a bike replaced is not only difficult butalso time consuming..

          A Similar incident happened with my Apache 150 back in 2007.

          The handles started wobbling and the "Service manager said no need to replace the forks" and he gave me a good technical explanation on why the handles wobble.

          But the Poor guy was not able to fix the problem, I reported the same in 4 services and just to keepup his statement he never replaced the Forks.

          I just waited patiently and did not visit other Svc centers to see where this ends.

          Finally after writing a detailed email to TVS, that the bike was not usable over many months due to the Manager and sent the evidences. They agreed to change the forks for free, even when the bike was out of warranty.

          I have also mentioned in the email that the entire frame and engine mounts have taken a beating due to this wobbling an requested for a replacement and the response was positive from Hosur, but I had to pay over 25K from my pocket and personally I did not like the RTR at that time (Which did not have the tank scoops and also heard the engine is not refined)

          So try writing a mail to them, I will go back and search for the TVS officials mail ids and help you out.

            My RTR's bore, head, carb and CDI was replaced in second service (3k kms) as i reported that the pick up was pathetic. They checked the bike and replaced all of them. They said it was because of some ply somewhere in the engine!

            its quiet common to see these in RTR's and Apache's!

              Thanks for the speedy response and apologies for the late reply.
              Its all over now and they have replaced it all under warranty, sad part is have to run the bike under 50 for another 1K Kms.
              The reason that I raised this issue was just to make sure that i was not cheated. Even I thought of the fact that if they are replacing all under warranty, we cant argue legally. But there is a seriousness on what they are replacing right.. If it had been anything outside the engine, i would be least bothered. Replacing bore and piston is like touching the core of the ride, thats why I was worried.
              Anyways, hoping that its fixed well and wont face the problem again

                Simlarly i had an issue with my Apache RTR 160 Refresh. Within 15k of ownership the bike started to smoke and the piston and rings were changed under warranty.
                There was one more problem when i had a crash the bike would vibrate so hard in some RPM range (5-6.5k RPM and 9k+ rpm) that i felt like i will fall off. After checking out everything in front of me, we found out that engine mounting bolt had broken a new bolt and everything was fine.
                Never upgrade without getting your basics RIGHT.
