Got caught by a police officer

  • Got caught by a police officer

    Hi friends. Today while returning home from school, I was told to stop on the side by a police officer. I was wearing a helmet and i had all the documents including my license but my PUC got expired 14 days back.
    He started talking to me rudely (though he was already ride) and said that either give me Rs.1000
    Right now or else you will recieve a challan by post and you will have to pay Rs.1250 in the court. I requested him to leave me but he told me 'abe jaa na yaar ,tere liye hum na baithe itte'(you just go man,we are not sitting here for you only).
    Now I don't know what will happen. He has noted down my license no. And RC no. Along with house address and my Dad's phone no. . Though my dad is telling me not to worry about the challan, he'll pay it but I just wanted to know that, is it legal to stop me on my way just to check the documents and then challan me if i fail to produce them? Am i supposed to pay the challan on it's arrival by post or i can ignore it? By any chance, can he register me for some other rule violence as ge has not given me any receipt? If stopping me for document check is not allowed then what action can i take against him? I am from faridabad, Haryana.

    Usually catching you or another rider is just a matter of choice by the cop, and usually even with no document you have a grace period, whereby spot fine isn't not the right thing to do. But don't worry, just because he got your number and details doesn't mean he's gonna pull the strings. But next time be prepared, as spot fine is now legalized for vehicles without PUC and Insurance.

      I don't understand why the cops are becoming so rude today. . ? Is it because they think they have all the power in their hands. . ? Seriously, I just understand it, the way the speak/communicate with you changes. . . I have observed this many a times but after a phone call made, their way of talking towards me changes . . . Anyways, yes it is kinda offence of not having a PUC certificate, . . Get it done if possible by tomorrow. . . I don't think he's gonna make some complaint or something, may/may not send you the challan, purely depends on his mood. . . Next time please make a video/audio recording of these people. . . I hate to say it but many cops are like this but there are few who are really good as stated above, you will get a free ticket even if you don't have the documents. . . If they send you the challan, just pay it, if it's extra which I hope will not happen, get a cop or someone whom your father or you know and deal via him. . . Have a problem with a cop? sought it out with the help of another cop . . .

      Don't worry nothing's gonna happen. . .

          PUC is "Pollution under Control". This is a certificate (Actually a visiting card size paper) which mentions the level of emissions of your vehicle against the standard level of emissions and certifies that they are within the standard limit. You have to get it renewed every 6 months. I think it is mandatory across India. Someone please rectify if I am wrong.

              First Puc is equal to size a little less than A4 sheet and about 4 Times bigger than a visiting card
              Second, duration is 3 months, not six months in bike (But cars made after 2010 can get a 1 yr PUc for a little more money).

              Third, it is Mandatory yes.


              Additional info
              Puc measures Co level output and HC level of your bike. Co level max =3.5 and HC level max= 4500 nhexane( For petrol here in dlehi).levels above this and you won't get a Puc certification.
              And note for you
              Either where you live, laws are little bit different or else I think you should check your puc certificate right away. ...!!


              Note for rest of riders. .
              List of documents police demands otherwise to earn money
              1.Driving license
              2. RC
              3.Puc
              And in last insurance.
              98% cases are of no valid puc

                  Anuj bro, this is India, if I failed to produce the DL, he would have asked for a couple of bucks for chai pani and would have left me. And he can't impound my vehicle if I don't have a DL, for that I would have ended up paying an extra fine of riding without a DL

                    My dad doesn't have any police contacts. May be that's why I ended up requesting that cop to leave me like a begger. I begged him for approximately 1.5 hrs. He refused . I just wanted to kill him .
                    In the meanwhile , I called my dad and i informed him , he asked me to give the phone to the cop. That thulla refused to talk to my dad. He said this to me in exact wordings' Mai to naa krra baat tere baap se, I am a govt. Servent, I am not entitled to talk to your father, I can talk to only my seniors. Koi Senior ko phone laga ske h to laga.'

                      Don't worry brother. I know I'm late to reply but here it goes.

                      Nobody can stop you just for paper verification unless you broke some rule. That's the law!
                      Second, if you don't have insurance or PUC, you have a 15 days period to get it done post which you can either pay fine or show the papers at the station and get your challan cancelled. Next time on, get a video of the entire encounter if they misbehave.

                          Traffic Police do have the rights to stop you and inspect following documents,
                          RC Card - Original
                          PUC - Original
                          Driving License - Original
                          Insurance - Original Or Attested Photocopy

                          If you don't have valid PUC or Insurance papers while riding/driving Traffic Police have the rights to fine you on spot (Fine amount varies from state to state)

                          As per the rules Traffic Police do not have the rights to fine you on spot if you do not posses Driving License & RC Card - One has the right to ask for Challan & appear in court with original License & RC Card after which judge will decide your penalty amount. However if you fail to produce the same it will be considered an offense and judge can penalize you with Challan amount as well as additional fine / jail time (Rarely happens)

                          Sadly Traffic Police are never interested in giving challan because its more paperWORK for them so either they will try to settle for bribe or let you walk free.

                          Places like Mumbai where now target system is applied Traffic Police will write a ticket for smaller offense and let you go, for eg. Driving without PUC is fined at Rs.1250 however if you insist on Challan stating you have the PUC but right at that moment then instead of challan they will try to make you pay spot fine of Rs. 100 & give you ticket for stopping on zebra line during Signal Red Light.

                          In your case you should have been fined by law however lazy a** attitude of a Traffic Police Inspector got you home free.

                          Taking down details of person they stopped is a regular play used by many Cops so don't worry about it, He was lazy enough not to write you a challan I am 100% sure he would do anything with your details as well.

                          PS:
                          Only Traffic Police have the rights to stop you & ask for paperwork of vehicle & driving license.
                          State Police have the rights to stop you & ask for your identification proof, if required inspect your vehicle but they do not have the rights by law to ask you for your vehicle paperwork.

                            Simply take out your phone and start recording. Cops usually fall back in line seeing this.
