  • Buyer is not transferring ownership of bike

I sold my bike last year but the buyer is not transferring the ownership of the bike. I have called him many many times but there is no response. As a proof of sale, I have a blank paper with his name and address confirming the bike purchase.
I am unable to register any vehicle under my name now as the RTO says that you already have a vehicle registered under your name. They are asking for additional tax.

I am from Hyderabad. What are the options I have?
There is no better therapy than riding a bike down a straight road at full throttle with the sound of the engine for company.

    Query Approved

That was a mistake on your part. You should have got the bike immediately transferred from your name to his. If the motorcycle is used at any time in an activity which requires police intervention. The cops will be knocking at your door.

I don't know what legal routes are available. The only thing i can think of is pestering him continuously till he gets the bike transferred to his name.

And let this be a lesson for you in the future!
Biking is not about what you have between your legs, its all about how well you use it!!!!!!!

The buyer may not be in a position to reply, but there are chances your bike may be used for illicit activities. Your main aim as of now should be to legally inform a lawyer, or the cops or someone verifiable in case the cops come knocking, so as to provide proof you didnt take any part in any illegal activities(worst case scenario).

As for the registration of another vehicle, wait for a period of time, say 2 weeks, before paying any additional tax for no reason. Keep calling the purchaser, and try to transfer ownership. Have you tries calling from any other phone number? In the small chance that he answers that, you must definitely take action.
Hope you sort this out, Best of luck.

He will only be jailed for doing it if the buyer has a copy of the receipt of purchase.

Why would you be taxed more, for having other vehicle on your name? I have 3 Vehicles registered in my name and never been taxed a penny extra.
And warn him, that you will file a missing report on the bike. Also record the conversation between you two for future use.

I too wonder why would you be taxed more? It is not a gas cylinder connection, that one person can hold only one on his name.

As per your issue of buyer not transferring the name, do you have any proof of sale? There is some process where you mail that to your local RTO via registered post to inform them the sale.

Good that you collected the duly signed sale receipt from him. I guess that should save you from any sort of legal issues.

I do not know what is the issue with RTO guys. Contact any @onlinesatish , @ravi@17bhp

Yes, you are charged an extra 5% if you have more than one vehicle registered on your name in AP/Telangana (each state has its own motor vehicle laws). Considering he now owns the RC390 he would be liable to pay an extra 10k or so.. the rto simply pulls up your details from past records. The same reason why I purchased my D200 on my Dad's name.
Some people get away by interchanging first name/last name, minor spelling changes etc.. but its all on your luck.

This point has been hammered home, but I would repeat just to reiterate the importance.

The new owner need not be criminal, but if he crashes in to an old lady and runs away, the cops will come knocking at your door. After a lengthy legal battle you might be able to prove that it was not you in the hit and run, but why risk the hassle. Take this matter up seriously. And as suggested, do have this matter recorded in a police station. Later if something unfortunate happens, at least you will have a record.

You should inform it to the RTO using form 30. It is available in any driving school, auto consultant or RTO office itself.

Re: Buyer is not transferring ownership of bike

Its an offence to ride a vehicle without transfer of ownership AFAIK. The RTO rule clearly states that whenever a vehicle is sold, the buyer should transfer the ownership of the vehicle and insurance policy to his name within 15 days of the purchase. The seller should obtain the photo copies of the same. Correct me if i am wrong.

Surely this guy doesn't have insurance right? I always cancel my insurance policy when I sell on a vehicle as I transfer my NCB to the next vehicle.
Beware of Bread, don't say I didn't warn you!
More than 98 percent of convicted criminals are bread eaters !
Statistics show that more than 75 % of violent crimes are committed within 24 hours of eating bread !
Bread is known to be extremely addictive. Subjects deprived of bread and given only water, actually begged for bread after just two days !
Bread has been proven to kill. Scientists have now uncovered alarming evidence that 100% of the people who eat bread will eventually die !

Better read the Motor Vehicle Act of your respective state. All the rules & regulations would become clear to you and then you would be able to take correct step.
