Technically, what ever the patents (if exist) are with Hero Honda will remain with Hero after the Honda's exit from Hero Honda. And as far as I know there are no patents with HH. Since Honda is voulantarily leaving the collaboration, they cant claim royalities on the bikesby Hero Honda till 2014 I think.

Not sure about it, but my 2 paise about it.

It will continue to charge the same royalty for technology support to Hero Honda as per the existing agreement that expires in 2014. “But if Honda decides to extend the technology agreement thereafter for two years, as demanded by the Indian partners, there will be a fresh agreement,” the second person said.
Hero still not looking for their own RnD as it seems, they still want tech support coming from Honda.. If you go by the said report as they seems to be asking for renewal of the tech support dill which is set to expire by 2014

Nope.. Hero would still end up paying royalty through their nose.. as they would still be using Honda technology till 2014. Royalty is not for JV.. it's for using technology. And as per news in ibn website.. Honda is demanding nothing short of Rs. 2400 crores as royalty till 2014!!! for this deal to go through.
