  • Madras HC allows TVS to use Bajaj's patented tech

Source: Madras HC allows TVS to use Bajaj's patented tech

TVS is now allowed to use the twin spark tech in it 125Cc bike Flame. Hmmm, I wonder if its just too late for that bike and it manufacturer?

oh man... this is another flaming news there...

I still remember how hot the Flame thread was last year. The bike lost its refinement and power at higher RPM's when they had to take out the second spark plug. Hope TVS would plonk that thing in to the existing bikes and/or a new flame would be launched with less decals (not looking so good)..

As such TVS has lost money on this big time. Bajaj won the game here. They made sure TVS Flame isn't a success.

      See what they say:
“The court has ruled that we have not infringed on anyone’s technology and we are happy with the verdict. The written copy of the verdict will be shared by the court tomorrow. The case has been going on for the past one year when TVS Motors had appealed against the order before a division bench of the Madras High Court,” said the official.
If people remember, we discussed about how at all Bajaj got the patent during 2005 in the first place as AVL has got a patent for the same stuff in 2002 itself. Something TVS raised in the court -

During the hearing TVS Motor has told the court that the vehicle is protected by a licence granted by a registered patent holder viz by an Austrian company called AVL List GmbH, globally known for the developing engines.
Well, finally, I think this is again an intermediate thing. Two questions still go unanswered:

      1) What happens to the Bajaj Patent - mostly it is still protected but people should stop reading between the lines.
      2) What happened to the Defamation case TVS wanted to launch on Bajaj?

Bajaj uses DTSI in 10 models. Hmm.... let us list them out -
      1) Pulsar 150; 2) Pulsar 180; 3) Pulsar 200; 4) Pulsar 220
      5) Discover 125; 6) Discover 135
      7) XCD 125; 8) XCD 135
      9) Platina 125
      10) ???

Yes, Avenger is the one that fills the 10th spot.

Also, they said 10 models and not 10 bikes. So may be if we take out the DTS Si ones out - the two XCD's and the Platina, the Wave & Kristal can come in. But, that would leave one spot empty. Or, one year ago when the case was filed we didn't have the XD 135 and Platina 125. That matches up things to 10

Their question was not about whether that model is in production now or not. The question was that the technology was used in a model that is/was sold in the market.

We all had a long heated discussion with final conclusion that TVS is right and the decision by the single judge wasnt exactly correct, the division bench has corrected it now. BAL must be thinking of talking it to the Supreme Court.

Well I think the judgement must be having more details, but IMO it would mean the patent continues till the dispute is sorted out in the Patent Office where it has been challanged. It entirely depends on that case.

It entirely depends on TVS, if they choose to pursue the case, they can claim for damages.

The particular patent is still with BAL and they continue to hold so, the patent granted to AVL isnt exactly the same, it wasnt affecting BAL except for that exclusive "twin-spark" status they had.

I still wonder if BAL would have used the same amount of money/time/energy on R&D rather that paying for Lawyers we would already have a better product in the market and winner for BAL. See the sales figures of TVS vs BAL despite Flame being a Big TIME flop, it sums up the whole case.

Hope they learn from their mistakes and do what they are supposed to do; make bikes

So well if the Judgement comes in favour of TVS .....will they deploy the Twin Spark Plugs in the Existing Bikes - which has Mono Spark Plug......In Free of Cost......?????

This is a question to be asked to the TVS People.....lets wait for a confirmed news on this.....

we might have just started seeing such things but the US market is very popular for many such things...

For one, did you forget the Basmati patent? Heck!

                              135 kmph Challenge ??

Hey Guys, Just read in TOI, Bangalore (pg3) that one company has advertised "Attain 135kmph on a bike of any make in similar segment, we will pay cash to buy that bike" . It seems the transport officials are furious about such ads that are driving youngsters into speeding/drag races in B'lore. Transport officials have hinted that in case of death, the company will be made co-accused in the 'murder'.
Which is this company ? Is it TVS ??.....RTR180 ??
