    New Delhi: Two-wheeler makers will now have to sell a helmet along with their bikes and scooters after the Supreme Court dismissed a plea by the Society of Indian Automobile Manufacturers against such a step.

    A Bench comprising Justice G S Singhvi and Justice A K Ganguly dismissed the petition filed by the Society of Indian Automobile Manufacturers (SIAM) challenging an earlier order of the Delhi High Court.

    The apex court said the manufacturers would have to give BSI certified helmets as "original equipment".

    On July 30, 2009, the High Court made it mandatory for dealers to sell helmets along with new two-wheelers and said that the vehicle would not be registered by the authorities without it.

    SIAM contended that the High Court order would restrict the people's choice to buy their own helmet. Moreover, it would also force a person to buy a helmet again when he buys a new two-wheeler.

    However, the apex court was not convinced with the argument and said, "Let there be more helmets. When you are buying a second scooter of Rs 40,000, then you can buy a helmet also, which is of Rs 300 only."

    In its petition, SIAM had contended that by the orders of the High Court, the choice of customers was curtailed, as they were forced to buy from the dealers of automobile companies and not from the open market.

    The association further contended that it was against the Motor Vehicles Act, which "helmet for a person" only and not "helmet for a vehicle".

    It also raised questions over the High Court's direction to provide only those helmets conforming to the Bureau of Indian Standards.

    "The High Court made a serious error in directing that all purchasers of two-wheelers have to purchase helmet only from the dealer.

    "This direction curtails the freedom of the purchaser to purchase helmet from the open market and third parties. It is also possible that in a particular case the purchaser may be buying a second vehicle and therefore may already have an existing helmet," said SIAM in its petition filed by counsels Vipin Nair and P B Suresh.

    I would say make the license giving procedure stricter! Giving a helmet with the bike doesn't ensure the purchaser would wear it! For once, I agree with SIAM about the possibility of monopoly of select players as this would reduce buying in open market.

      er...300Rs Helmet?

      well the is good and bad...will force dumb riders to wear a helmet or at least hope they will.
      but what abt for ppl like us who do wear helmets and already own a decent one?

        What if I would like to buy a Studds helmet something that's worth 2K & don't want the cheaper ones supplied by the company?

        Why not address the base problem of driver education & then take all these steps?

          Silly ruling!!!! Rs 300 helmet!!! I doubt it would be any help at all in a crash! This is what happens when people who are ignorant about "such" things make decisions.

          India has got the dubious distinction of being the capital of road deaths because of such "tughluq" decisions.

            This would do good to the Helmet manufacturers. Just imagine the number of cities in India where helmet ain't a compulsion yet(It includes big ones like Pune too.Sad it is though).

            Now if they sell it for Rs.300 imagine what the quality would be? Since the number of helmets sold would be equal to the number of bikes(millions per year) the profits would be great but the safety factor which is being tried to address here, I doubt would be realized.

            Instead why don't they make wearing Helmet a mandate everywhere?

            That way even if not for safety reasons, people would wear it out of fear of fine

              I see most of us concerned with Rs 300!!! I was wondering, if the helmets are being produced in mass, will it not bring down the price & retain the same quality? Again, we do not know which present make/model is being offered for Rs 300.

              To me, it shows the ineffeciency of the Govt to enforce strict law to mandate helmets & thus seeking regressive ways!!!

                    Good thing that I won't be buying a motorcycle for ages now.

                    This is a dumb ruling, Seeing the helmets stocked at HH showrooms or bajaj or whatever, they arent half as good to protect. Would just help to sell helmets. Even if a person does wear helmet, almost 98% of the users i see in bangalore dont have it strapped properly on the head, that's as useless as not wearing one.

                    The law for making helmets compulsory all over India should have come first, and if that didn't work then this.

                    *sigh* We're not heading nowhere regarding road safety..

                          This rule is already there in Hyderabad-the dealer is supposed to give a certain receipt when the bike goes for registration, proving that a helmet was also purchased alongwith the bike. But most of the customers manage to get away with the receipt alone, not the helmet!
                          In my case I did buy a new helmet, but not the showroom one. I gave him the same bill&he submitted that to the RTO during registration process.

                          I feel its right to make it mandatory to purchase a new helmet with a bike&also submit the bill, but limiting this to the dealer is not acceptable, as this would dent the sales of helmet shops, which have far better range&quality.

                            Please mind your language. I hope you know that abusing a judge or court judgment amounts to contempt of court.

                            Moreover, most of the guys here are concerned over the Rs. 300 figure. Will you get a scooter or a motorcycle for 'exactly' 40,000 rupees?? Did you guys even read the report fully? Its just a relative figure that judge gave to explain things in that perspective. Are we so dumb to know that court cannot decide the price of the helmet. Its a right step in the right direction, but not enough. Yet, I hope it will save some more lives.

                              I would call this ruling funny, not because I want to debate on the sensibility of the jurisdiction, just that as I said earlier, I need policing to tell me that if I eat poison, I will die, if I stand in front of a train, I will be killed.

                              Surely, most of us are dumb, because we need people/ rules to learn the basic rules of survival.

                              I certainly doubt the difference this ruling will make to the death rate in two-wheeler accidents. Certainly, this ruling would ensure that each new bike owner gets a new and hopefully ISI marked helmet, but what ensures the rider to wear it. I still see some steel-heads riding without helmet, are we sure they dont have a helmet back in their home.

                              The concern here should be to educate people that wearing a helmet is the first thing an intelligent brain with a weak skull should wear. And further, I would want the biking forums like ours to bring about this awareness. Lets not leave this for some policing authority to protect us.

                              P.S II: I wonder will this rule of selling a vehicle be applicable if the vehicle is purchased and registered by a SARDAR ji or a Lady, who have sought for a relaxation from wearing a Helmet. Steel-Heads you see.
