Sorry if I was a bit pedantic about this.

There is an agreement about wages in place (as had been spoken about in the media) which is to last till 2019. The interesting part about this tangle is that neither party has given any real details about this agreement to the public domain.

How does Bajaj plan to raise wages? Year On Year (YOY) basis? And such a raise would be linked to what? The current rate of inflation or to the workers' productivity (incentivisation) or to the Wholesale Price Index (WPI)?

There is much rubbish being thrown around about shares being demanded by workers at Rs 1 per share. I have never heard unions, however militant they may be, condone such utter s**t. Employee Stock Ownership Plan (ESOPs) are written into contracts with each and every employee as per grade/level whatever formula. Thereby, such an employee has the option to pick up/set aside for oneself, as per the rules blah blah, a pre-decided quantity of the firm's stock at highly discounted rates, usually at face value e.g. Rs 10 per share, if the declared face value is Rs 10, that is. If this option is denied, it is a breach of contract by the management and if this option is demanded AND a strike is resorted to in order to force the management's hand, it is again a breach of contract by the workers.

No clarity has emerged on the conditions under which a worker's services may be terminated. Given Bajaj's good corporate governance, I doubt that Rajiv will make any mistakes here making him liable to litigation.

Unless Rajiv or somebody at the very top has made serious blunders, I foresee this issue being resolved in the favour of the management. Please note, giving in to UNFAIR demands (the caps are my way of emphasizing my quasijudicial stance) will open a veritable Pandora's jar of maladies for industrial India as a whole, leave alone the auto hub of Chakan. And the surrounding firms know this.

Again, wait and watch - Manmohan Singh's policy

I think it is very much in public domain that 12% YoY hikes were committed in a contract valid upto 2019. I'm don't have any knowledge about the terms but the contract was signed only a couple of years ago to ensure there was no uncertainity and agitation in years to come. The union decided to declare the contract void and demand for a 25% hike instead, which IMO is downright greedy.

icemang Very true. I also appreciate the fact that you take the time to type out your logical posts/ comment. Unfortunately, the general reaction to a long (intelligent) post is to reply with a TLDR (Too Long Didn't Read!).

As you have mentioned, the courts have now asked the management and unions to 'amicably' resolve the issue, thereby skirting the responsibility of giving a free and fair judgement! Which in realistic terms means more arm twisting and threatening from both parties. When the Court of Law is approached, they should do their duty and not throw the onus back on the complainant.

Here, I am sorely tempted to relate an incident about how our own Iron Lady, the redoubtable Indira Gandhi broke up a strike at a DEFENCE PSU (!!!!) sometime in the early 80s. I was not a witness to the strike but saw at first-hand, its implications on the family. I tried to Google for it but no joy. I really don't think that this incident made it to the media of those times. I cannot give any details as I am a signatory to the OSA. Suffice to say that the action was swift, brutal and effective. Can relate it to my Pune chapter friends at some G2G, off the record, of course. Not very pleasant memories of that day, lost two good friends in the aftermath...

Due to our arcane, antediluvian and anachronistic labour laws, the courts are s**t scared of giving a conclusive verdict either which way, in the fear that this verdict would act as a precedent by future litigants. Really, really sad state of affairs. Productivity down, investor sentiment down, Liberalisation Privatisation Globalisation being flushed down the wc, the rupee down. Difficult times for India these days. At this rate, it won't take long for the hemlines too to come down and that IS bad

Talks fail to end Bajaj Auto stir; union to meet labour minister tomorrow

Talks between the Bajaj management and its employees' union today failed to resolve the 16-day old strike at the company's Chakan plant over wage revision and other issues.

"The meeting with the management in the presence of the labour commissioner did not yield any tangible solution and so our agitation will continue," Bajaj AutoBSE 1.35 % Chakan plant union sources told PTI.

The meeting was, however, positive, they said, adding, "We will resume negotiations on Friday."

The company's management, meanwhile, could not be reached for comments on the meeting.

Sources further said the union leaders will also meet Maharashtra's Labour Minister Hassan Mushrif here tomorrow to end the deadlock.

Around 1,500 employees, including 600-odd contract and temporary workers, have stopped work at the Chakan plant since June 25, demanding wage revision, better work conditions and stock options.

The Chakan belt, famous for the auto sector, is home to a host of big industry names including the Tatas, the Mahindras, the Mercedes-Benz and Volkswagen.

Today's meeting was attended by Bajaj Auto Vice President for motorcycle business Kailash Zenzari and other senior officials, while the union was represented by its president Dilip Pawar, General Secretary Balasaheb Surve, and others.

Good, the strike is progressing as usual or should I say unusual given the times we live in. The worker-govt lobby is retracing its socialist ladder down to hell. There is no rule of law no accountability and last of all no justice in this country.

Labour court raps Bajaj Auto union

Pune, July 17:
The Pune labour court gave the Bajaj Auto union a rap on the knuckles and dismissed an adjournment application filed at today's hearing.
The application asked that Bajaj Auto submit payslips to enable workers know on what grounds their June salaries had been cut.
The labour court judge N.S. Kole said that the matter was technical and the union did not seem to be sincere in its desire to find a solution.
The court said that the matter will proceed on July 22 irrespective of whether the union gave a written submission replying to Bajaj Auto’s say or not.
Workers belonging to the Vishwakalyan Kamgar Sanghtana, the workers’ union, stopped work at the Chakan plant from June 25 to press for their demands, which included wage revision, ESOPS and reinstatement of 22 suspended workers.
In its first hearing on July 8, the court had suggested that the two parties resolve their issues through discussions.

Rajiv Bajaj refuses to relent, will not give free shares to workers.

Rajiv Bajaj -

“Even if the plant shuts for next 500 days due to strike, we are not giving a single share to any worker for free of cost. It does not fit into Bajaj’s culture. Even the top management, including the chairman of this company, has to pay for the shares. I am definitely worried if the strike continuous for long not because the production hit, but because of loss of culture of this plant. The plant was set up to develop new processes; it is a laboratory for advance technology. The products manufactured in this plant have made Bajaj a global bike maker. There are a few rotten eggs which are spoiling the entire basket. So far, the plant had never faced a problem. We have established a culture in plant as per the Kaizen norms,”
“We are obliged to pay wages but not shares. We do not gamble salaries with issuing shares. This is applicable to information technology industry or start-up companies, where capital is an issue. For automobile companies, ESOPs (employee stock ownership plan) is not suitable at all. Companies such as Tata Motors and Mahindra & Mahindra issue shares only to top management in the R&D division and not to workers. We don’t buy loyalty of people by throwing shares to them.”
The union has learnt a lesson from the past and repeating the same mistakes. They are giving a false hope of getting over Rs 10 lakh (the approximate stock value of 500 shares of Bajaj Auto) for just Rs 500),”

Bajaj Auto hearing postponed

Today’s hearing of a petition filed by Bajaj Auto in the Pune labour court has been postponed till tomorrow.

The petition prayed that a strike by 900 workers belonging to the Vishwakalyan Kamgar Sanghtana, the operative Union at its Chakan plants since June 25, be declared illegal.

The Additional Labour Commissioner, Pune, R.R. Hendre, has been presiding over discussions held between the Union and the Bajaj management to help resolve the issues. The meetings, the last held on Saturday, have all proved to be inconclusive.

Bajaj Auto says that today, around 757 workers reported to work and expect to produce 2,000 vehicles at Chakan and 1,100 Pulsars at its Waluj plant in Aurangabad. With this, the company has achieved 100 per cent of its requirement of all brands of the Pulsar, Avenger and KTM, it said.

On the BSE today, the Bajaj Auto share touched a high of Rs 2,008 before closing at Rs 1985.85, nearly one per cent higher over Friday’s closure.

I just love Mr. Rajiv bajaj. No political answer. Whats wrong is wrong. This should give those striking workers something to think about. Mr. Bajaj is right when he talks about culture.

This scenario should be handled well and should be nipped in the bud before it sets a precedent.
