A traffic constable will now no longer be able to walk away with your driving licence when you commit a traffic offence or when he is in a mood to make an extra buck. And we have Chief Secretary (home) U C Sarangi to thank for this.

The traffic department on Thursday issued orders barring police constables from seizing traffic offenders' driving licences, an arm-twisting method often employed by cops to get people to pay bribes.

The orders were issued by Joint Commissioner (traffic) Vivek Phansalkar after a traffic constable sought to seize Chief Secretary (home) U C Sarangi's son's licence for a traffic offence at Parel on Wednesday.

Sarangi and his son, who was at the steering wheel, were driving down the Parel flyover towards Dadar on Wednesday evening when they turned into one of the lanes near Parel TT bridge which happened to be no-entry.

The car was stopped by a constable who got into an argument with Sarangi's son when the latter refused to give up his licence, knowing fully well that constables do not have the powers to take away a driver's licence.

As the argument grew louder and nastier, Sarangi's son asked the constable if he knew the man sitting in the co-driver's seat. When the constable said no, Sarangi introduced himself as the boss of his boss (Police Commissioner Arup Patnaik). From the spot itself, Sarangi called Patnaik and told him about the incident and directed him to take steps to stop this extortion by his men.

Under the Motor Vehicles Act, only a police officer of the rank of assistant sub-inspector and above has the power to seize a motorist's licence or fine him. However, for years traffic constables have been robbing people by threatening them with forfeiture of their licence.

When Mumbai Mirror contacted Sarangi, he played down Wednesday's incident. "That incident is not important. What's important is that we are trying to change this. There is a proposal pending with us to empower head-constables to seize licences and fine traffic offenders. We will speed up the passage of this proposal."

Since traffic constables can't fine a motorist and thus do not have an opportunity to make money on the side, they take the offender's licence away and ask him to collect it from a police station the next day after paying a fine of Rs 100. The motorist is then given a receipt which he can produce at the police station.

More often than not, while preparing this receipt the constable offer to settle the matter for Rs 50.

It is not a secret that constables hide around one-ways and traffic intersection waiting for motorists to slip up. But now you need not fear them. Remember a traffic cop dressed in white and khaki (constables and head constables) does not have the right to seize you licence (they can only check it), nor can he charge you a fine.

does it hold true for Pune as well? i was fined by a constable, on the very first day i landed in Pune. He checked all my documents, found them in order, then said you are not wearing seatbelt...do you want me to "cut a parchi". i requested that it be my first day, i didn't know....so he asked for 100 rs....i said you better "cut" a parchi now, i won't pay anything like this!
then i had an argument over two issues....he didn't stop any one with out helmet, why me without seat belt? (he said, orders are not yet clear from court about wearing helmets, but for seatbelts we are strict)...second where was his superior officer who actually is "supposed" to fine me?(he said wait here for few hours, he has 16 places under his control, when he comes, take your licence from him, or come to his office tomorrow and collect or pay fine here and take it)!! Finally i had to give in and accept the receipt of fine, as i was with my wife,and didn't want to make her wait on a square!

when i asked him where did he fill the fine-amount on that slip? he replied that the code (some letters with numbers) written by him was the indicator of my "crime" and me being fined by him!! he cut my copy of receipt by two lines (as we do to cancel a cheque) and asked me to sign on reverse side of his yellow colour slip.

can any one please tell me what do i do here, when i am stopped like this, and i know i am on right side of law (may be on wrong side partially, but less then the guy charging me!)

1. You were not on right side of law. Use of seatbelt is mandatory in Pune.
2. Section 130 of Motor Vehicles Act 1988 states that -
The driver of a motor vehicle in any public place shall, on demand by any police officer in uniform, produce his licence for examination:

Provided that the driver may, if his licence has been submitted to, or has been seized by, any officer or authority under this or any other Act, produce in lieu of the licence a receipt or other acknowledgment issued by such officer or authority in respect thereof and thereafter produce the licence within such period, in such manner as the Central Government may prescribe to the police officer making the demand.

Section 132 of Motor Vehicles Act 1988 states that -
(1) The driver of a motor vehicle shall cause the vehicle to stop and remain stationary so long as 1[may for such reasonable time as may be necessary, but not exceeding twenty-four hours],-
(a) when required to do so by any police officer not below the rank of a Sub-Inspector in uniform, in the event of the vehicle being involved in the occurrence of an accident to a person, animal or vehicle or of damage to property

Section 133 of Motor Vehicles Act 1988 states that -

The owner of a motor vehicle, the driver or conductor of which is accused of any offence under this Act shall, on the demand of any police officer authorised in this behalf by the State Government, give all information regarding the name and address of, and the licence held by, the driver or conductor which is in his possession or could by reasonable diligence be ascertained by him.

Section 158 of Motor Vehicles Act 1988 states that -
(1) Any person driving a motor vehicle in any public place shall, on being so required by a police officer in uniform authorised in this behalf by the State Government, produce-

(a) the certificate of insurance;

(b) the certificate of registration;

(c) the driving licence; and

(d) in the case of a transport vehicle, also the certificate of fitness referred to in section 56 and the permit, relating to the use of the vehicle.

(2) If, where owing to the presence of a motor vehicle in a public place an accident occurs involving death or bodily injury to another person, the driver of the vehicle does not at the time produce the certificates, driving licence and permit referred to in sub-section (1) to a police officer, he shall produce the said certificates, licence and permit at the police station at which he makes the report required by section 134.

(3) No person shall be liable to conviction under sub-section (1) or subsection (2) by reason only of the failure to produce the certificate of insurance if, within seven days from the date on which its production was required under sub-section (1), or as the case may be, from the date of occurrence of the accident, he produces the certificate at such police station as may have been specified by him to the police officer who required its production or, as the case may be, to the police officer at the site of the accident or to the officer-in-charge of the police station at which he reported the accident:

I wonder why those riders dint turn up who wanted to learn cornering and wanted some gyaan from the gurus...Also who wanted practical experience and not theoretical knowledge

Missed induction ride . However had a great fun over long weekend with 737 Kms of solo ride in Konkan region. . Will upload photographs and details soon.

Road Update: Ambenali ghat (Mahabaleshwar to Poladpur) is under renovation . Around 20-25 Kms road is smooth. Remaining patch is worst. Kashedi ghat is as amazing as ever (only 5Km patch is worst) with good high speed positive corners.

The G2G ride to Lavasa was super!

Big Thanks to Rohit to make it possible! This was my first time I rode in the formation, no lane cutting, everyone followed the rule. And the ride was initially led by none other than the cornering expert Roger! Learned a lot things about the group riding. And it was a cornering fest there! I had to leave early as I had to office to attend in the noon.

I will upload the photos that I clicked soon.

Sorry everyone i missed the Lavasa session, as had some hospital visits and other important shoppings piled up.

It seems you all enjoyed lavasa a lot specially with guru sagar.

@ Hari -i had smsed you over the phone that you should have put that you need gears for one day ride on the thread and some arrangement could have been done, as we already have rule that you can use ask for gears for 3 rides and you have to pay 50/- Rs to rohit each time for using it as we use the funds to buy new gears. In fact, i was not riding out of city on sat and sun so i could have lend mine gears man.

@ eshan - Dont behave like the hidden cops about which everyone is mentioning here today, if you wanna attack me regarding practical knowledge about cornering, than Take my name clearly. And i already told the reason for which i dint turned up.

I had a my first ride yesterday with the group and it what an experience it was... and the most enjoyable moment was cornering..(learning little bit and clicking the photos thanks to seniors and everyone
