Whats an OGL? And I am just wondering about the Comet, the Funduro... Maybe they came through the CKD route but all below 800cc.

Anyway this came up on a google search, a dept of commerce press release; http://commerce.nic.in/PressRelease/...il.asp?id=1999

GOVERNMENT PERMITS IMPORT OF MOTORCYCLES OF 800CC ENGINE CAPACITY OR ABOVE SUBJECT TO CONDITIONS

    Date : 13 Apr 2007
    Location : New Delhi

    PRESS NOTE
The government has permitted import of motorcycles of engine capacity 800 CC or above, with following conditions:
    1. The imported motorcycles must meet Euro-III emission norms.

    2. In place of homologation, at the time of import, the importer has to submit:
    1. Type Approval Certificate / COP of an international accredited agency from the country of origin along with notorized English translation of the certificate.
    2. The Type Approval Certificate has to state that the vehicle complies with all the ECE regulations for the complete vehicle.
The above conditions shall be applicable in imports by following category of importers:
    1. Individuals;
    2. Companies and firms; and
    3. Original equipment manufacturers who have manufacturing and service network in India.
Directorate General of Foreign Trade (DGFT), Ministry of Commerce and

Industry, New Delhi, 13th April, 2007

BUT the customs has no law prohibiting the import of motorcycles of any capacity as they have a tariff for the same, see section 8711...The standard rate of Customs duty on a motorcycle upto any capacity is 100% per unit, so I guess its on a CBU unit.

AND a very interesting find, though it says that import of motorcycles below 800cc is not allowed, the data bank reflects otherwise:

It has to be right coz the 500-800cc category has been imported the most, and I know for a fact that there are more 600cc machines on the road than the other capacity ones.... sorry the excel table didnt copy right

    All very confusing

very confusing indeed. however the first part of your post confirms what I wrote. about the second part, when in doubt ask an expert. customs laws experts have told me under 800cc bikes can't be imported under open general licence. don't know about comet and funduro.

Would this '800cc and above' rule apply to TR aswell?

Does anyone know what the tax is for importing a brand new bike on TR?

        I've heard 60% and also 135%.

        Anyone?

        Thanks.

I don't think you can import new bikes on TR. One of the rules state that you must have owned the bike for at least a year. I may be wrong and there are numerous experts here who can clarify the position.

No, the 800 cc rule does not apply to TR. The 600s brought down on TR are the only clean paper 600s around, all others have shoddy paperwork.
You cannot import a new bike on TR, you have to had owned the vehcile for a period of one year in the foreign country before you bring it down, and the vehicle cannot be sold for a period of two years after being brought down.
The vehicle is valued at 10% depreciation for each year, maximum allowable depreciation going upto maximum 70%, anything older than 7 years will be given maximum 70% depreciation benefit.

              Thanks guys.
Is there a penalty if I were to bring down a new Bike on TR?
              If so how much?
Or do they simply confiscate such imports?

                  Legitimate Import?

A friend of mine who is a British citizen visits India frequently on work. He told me that he is allowed to import one car or motorcycle for use in India. How true is this? If it is true, what are the regulations regarding this? I am OK with not having the bike transferred to my name immediately. My specific questions are:

                  1) Is there a minimum period for which he should have owned the motorcycle before bringing it to India?
                  2) Is there a cut-off date for the manufacture year of the motorcycle or can it be any year (right now I am looking at a 1998 CR-500 but if that is not possible, I might go for a 1 or 2 year old CRF450)
                  3) What is the minimum period for which he will not be allowed to sell the bike to me (I have heard it is 3 years, can anyone confirm)?
                  4) Will it need to be homologated by the ARAI or some other body before it can be registered for use in India by him?
Who needs more than 70 bhp when you don't need to slow down for the corners?

                      ans.1- no
                      2-no
3 & 4...... this stuff will be declared on a foreign nationale's passport and he has to take it back while returning home. he cant ever sell the bike.
and needless to point out that these rules apply for foreign citizen only. no relevance to nri s or indian citizens.

A warm hello to all fellow rider!!!

I have been redirected to this thread as I have some similar questions to ask. I hope to get some ans here.

Background: I am in nz and moving to India in 2 months from now and would like to bring my bike along. I have sold my cbr1000F a week back and thought will buy something more suitable for track n show off(lol).

                            1) I will be buying an old bike for the rest of my stay: anything between 94-2004 as it fits my pocket well. could be a 600 or a 750 or a 900 or a litre. wouldn't mind anything really. Can i bring that old a bike back home?

                            2) I have been reading a lot of fuss about 600cc not being able to get through customs... don't pour me with jargon's like TR n crap. I don't know what they stand for... is it true? if the ans to both is yes, i can play smart n pick something bigger (as we all know: Bigger the better )

I am ok paying 120% import duty as the bikes I have been targeting are pretty old and the depreciation will play an important factor. So, if the answer to the above questions is YES, then what sort of papers am I looking at. anything in particular?

Also, how's the second hand bike market in India?specially for 600's n bigger ? What sort of a price am i looking at?

Hope to get some clarification on this.

n yeah!!! good to see sooo many indians kicking around on their machines....

                            jai hooo

You will get a depreciation of 10% for each year, maximum depreciation being 70%.
For example if you buy a 2008 bike for say 10000 usd, and bring it down in 2010,k you will get a depreciation benefit of 20% being 2000.
So the import duty that will be charged will be applicable to 8000 USD.
If you need finer details, just ask, and i mostly should be able to answer most of it as i know two people who have brought down bikes after their stay in the US.
