TVS Motors dispute with Bajaj Auto over disparaging ad campaign of claiming false fuel economy of TVS XL100’s against Bajaj’s entry level bike CT100 has comes to an end in the Madras High Court.
Bajaj Auto has withdrawn the said Ad Campaign and submitted a memo in Madras High Court for the same. The court has taken the memo into file and issued an order.
In July last month, TVS Motors had filed a civil case in Madras High Court against Bajaj Auto for making a misleading claim about TVS XL100’s fuel economy. The Madras High Court had also granted TVS Motor a temporary injunction against Bajaj and asked the Pune based motorcycle maker to file a detailed response within two weeks and temporarily restrained them from continuing with its advertisements for that period.
TVS Motors has now sought a permanent injunction from Madras High Court restraining Bajaj Auto and other two-wheeler manufacturers for continuing any such advertisement which allegedly disparages the TVS Motor’s product TVS XL 100 by comparing the fuel efficiency on the basis of false figures.
TVS Motor had also sought the court to direct Bajaj Auto to compensate Rs 25 lakh because of unfair trade practice adopted by them.
According to the memo submitted by Bajaj Auto, the company has withdrawn the comparative ad campaign and also agreed not to reintroduce any such advertisement either by itself or through its dealers.
An order issued by Justice Pushpa Sathyanarayana said, “Accordingly, the memo is taken on file and the suit is decreed in terms of the memo dated August 8, 2016, filed on behalf of the defendants (Bajaj Auto). The memo shall form part of the decree. No costs.”
