Gosh... the bike wont be "confiscated" or anything! And what trouble is gonna come at his doorstep?? Ursrajj, normally I'm all for suing them if you have been wronged... but I'm afraid you don't have a very strong case. Fact is, this is India and tolerance levels about such things are way high. The court will 99% give TVS a chance to fix the problems. On the other hand TVS is usually responsive. I suggest you take this up at the highest level... and get a company engg. to look at your bike. This would be your best option, IMO.

Dude, Thats what i too said, by what u've told thats highlighted in bold!! The court will definitely ask TVS to take over his bike for a detailed check-up and that will take weeks altogether for them to respond back to the court! If the bike has to be evaluated, it has to be done by a neutral third party... not by TVS. And for that also, you may have the option of getting that done in front of you. In any case its never a good idea to let your vehicle out of your sight. Furthermore, you can claim losses incurred for arranging alternate modes of transport. Whether you actually get compensation for that will depend on how your case goes...

To tell you honestly, you have to give the service people chance to look at bike for issues, at this point of time you case is weak. Take your bike to the service center today/tomorrow and in the meantime write a strongly worded mail to TVS officials provided in the link in the post mentioned earlier.
Make sure you mention all the troubles/harrasment caused to you and also that the company has to pay for transporting the bike to service centre and properly repair the bike or else you have the legal options open.
Make sure you get the issues sorted out and also have a record of the problems and soultion and keep it safe(they will obviously generate a final bill for you), you will need it when you decide to take the legal route. Also make sure you have the details of officials of dealership and the company who get in touch with you, that will be very helpful..
EDIT: Hey btw as per the symptoms, get the following things checked:
1) Battery
2)Magneto Coil
3)Wiring

Hey guys just wanted to ask one thing about Apache....as I havent ridden one but many owners say that their is a vibration factor on the whole of the bike when ridden at high speeds.....
is it true???
if yes then how does it affect your confidence while riding her at high speed...???
what speeds have been attained by the riders who own them???
does vibration causes things to go jarry a bit in the bike????
and could the TVS guys rectify this problem or could they give an explanation as per why this vibration exists at first place???????
has this problem been fixed by TVS for the upcoming models????(180 menace)

The vibes are normal for engine. but as thr is no rubber bushes for handle bar mountings, they feel little more. The vibes are less on Fi. But once u use RTR for few days, u become habitual to it, and its no more a problem, considering the fun of ride and performance.There's lot to it other than saddle....

thanks a ton for all your replies..some how i took it to Service station today,,,they have inspected & responded that there was an air blockage in the fuel tube & its been rectified..& they have also assured that ill not get this problem again,...im going to get my baby tom...i will keep you all posted reg the status....
