  • Re: Need help- NOC Process for Andra Pradesh Bike in Navi Mumbai

    Hello Guys,

I have brought my Bike (originally registered at UP) to my home-state Himachal Pradesh (H.P) in the year 2011. Now its 2015 but I have not transferred it to current state i.e. it still has UP number on its number plate. Is it mandatory to do so ? I mean can't I go on with my UP number in my state.

Also, I looked up the Motor Vehicles Act 1988 and under Sec 47 of the Act it is clearly mentioned,

    47.
Assignment of new registration mark on removal to another State

    (1)
When a motor vehicle registered in one State has been kept in another State, for a period exceeding twelve months, the owner of the vehicle shall, within such period and in such form containing such particulars as may be prescribed by the Central Government, apply to the registering authority, within whose jurisdiction the vehicle then is, for the assignment of a new registration mark and shall present the certificate of registration to that registering authority within whose jurisdiction the vehicle then is, for the assignment of a new registration mark and shall present the certificate of registration to that registering authority, that an application under this sub-section shall be accompanied—

    (i) by the no objection certificate (NOC) obtained under section 48,
    or

(ii) in a case where no such certificate has been obtained, by— (a) the receipt obtained under sub-section (2) of section 48
    or

    (b) the postal acknowledgment received by the owner of the vehicle if he has sent an application in this behalf by registered post acknowledgment due to the registering authority referred to in section 48, together with a declaration that he has not received any communication from such authority refusing to grant such certificate or requiring him to comply with any direction subject to which such certificate may be granted: Provided further that, in a case where a motor vehicle is held under a hire-purchase, lease or hypothecation agreement, an application under this sub-section shall be accompanied by a no objection certificate from the person with whom such agreement has been entered into, and the provisions of section 51, so far as may be, regarding obtaining of such certificate from the person with whom such agreement has been entered into, shall apply.

If I am not wrong then the Vehicle transfer i.e. getting number of my current state i.e. HP can be done without an NOC also as per the provisions of the Act.

Any legal luminaries here would like to clarify please !!!

Also, I am in no position to go to UP for getting a NOC, if at all this whole thing comes down to getting one. Can this whole process of Vehicle transfer to my current state be done without me having to go to UP?

          • Do's & Dont's when selling a Bike in another State

I am planning to sell my Pulsar 220 which has an Uttar Pradesh registration in Bangalore - Karnataka. I have been in Bangalore since 3 years. Wanted to know if I'm selling my bike to a person who is from Karnataka then in that case how will I get my bike transferred to his name.

A complete procedure/ Do's & Dont's related to bike transfer would be really helpful.

              Approved and merged!

First of all, you WILL have to pay LTT. Then apply for change in ownership. I'm sure members would know exact details.

There might be stay orders again on the LTT for NON KA vehicles. Not sure, how much the news is true. I am commuting daily on the roads which have RTO jeeps in between but currently they are more focused on the four wheelers as the tax is high viz-a-viz two wheelers.

I wanted to know the procedure of transfer though!

Ashish, you will first need to get an NOC from Lucknow and then get it registered again in Bangalore with the new owner's name. This will cost both time and money for you as well as the guy buying the bike.

My suggestion would be to ship your bike by train to Lucknow and sell it off there. Will make life a lot simpler, especially if you have family/ friends in Lucknow who wouldn't mind doing a bit of running around for you.

Avinash, but i feel the resale value would be too low there in Lucknow. Very few people buy a 2nd hand motorcycle in states like UP,MP,RJ,GJ etc. In Bangalore the resale value is pretty good but for KA registered bikes. The transportation cost will also be close to 5K now as it was 3.5K in 2012.

Anyway, that would be my last option.

                    Thanks.

The resale value maybe better, but you need to factor in the additional cost variables like cost of paying KA LTT + cost of NOC at LKO + cost of reregistration in BLR + cost ownership transfer.

If after all these over head costs it is still better resale value (+ inclusive of cost headache caused due to all the running around you will need to pay above costs) then go ahead with the sale, else do what The Monk says and save yourself a LOT of headache.

I agree with you. Just a query/concern - Wouldn't the LTT and Registration in BLR be the same? Or isn't it like if i get a fresh KA registration done then LTT should not come into picture (something like that). Also, for a legal transfer of the bike it should always have a KA registration?

If yes, then i will definitely sell it off in Lucknow. Thanks for the input.

                          It goes like this :

Step 1 : Get NOC from home RTO
                          Step 2 : Pay LTT
Step 3 : Refund pro-rata LTT in home RTO (optional, as this process takes years at times)
Step 4 : Re-register bike in new state
Step 5 : Once buyer confirms, initiate ownership transfer

Each of these steps cost some money and except #3 all are mandatory !!

Is there any problem with my filter ?? i dint removed my filter box and also i dint tuned my bike for good milege but now it seems bad after inserting the power filter than the stock filter please help!!!
