    Your only bet is an advocate specialized in accident cases. There would be a bunch of them. You just need to approach some and ask for it.

    A third party claim is made only upon a court order.

      So it means i specifically want them to lodge complaint (coz i have already made the report + statement from my side). but then in that case if she sez that it was all her fault in her statement.. still we wont get any claim.

      I feel its time we got her shifted to a govt. facility. as this pvt. hospital is proving too expensive and i am not hopeful of any 3rd party claim coming from insurance..

      P.S.: The concerned Neurosurgeon (is a family friend) who saw the CT scan report specifically told me "Sirf dashboard toota hai.. machine theek hai" (English translation "Just the dashboard is broken, machinery is alright" so i wouldn't doubt that). Face X-Ray was seen by a dentist (My best friend) and concluded that the jaw would require surgery but broken teeth were probably due to bad oral hygine followed, a few were actually not there even before the accident as confirmed by the woman's son. And actually the dislodged teeth was a good thing for her as it would anyways have been extracted for the surgery.

        Well, this is much serious than what I'd thought ; Approach a reliable lawyer experienced with accident cases & complete the FIR process as soon as you can with his help.

          Update on day 28:

          Regenerative Surgery was performed on jaw on March 26 (day 6).
          Statement of woman could happen only on April 10(Day 21) due to her immobilised post-sugery jaw.
          Woman discharged from hospital on day 24 (i.e. after 24 days of hospitalization) (13 April) total hospital bill paid >60k
          Bike finally reaches PBK on day 27 (16 April) estimate received of 19k
          Insurance claim documents (minus police documentation mentioned below) submitted Day 28 (17 April)

          Total money paid to buy bike on Aug 4 2009 (Rs.78220) < total expenses in accident.(above)

          Update on Day 29 (April 18): Went over to police chowki at 1PM. From there on, went to accident spot, explained when + how + where + what happened. Panchnama copy will be handed over on 19 April (Day 30) at 8 AM. (the guy is on night duty from tomorrow.)

          Day 30 (April 19) Went to Police chowki on 19th morning at 7:55 AM for ^^ . But papers weren't done. Still gave signatures + witnesses signatures and was told to report to court on 20th morning as my case would be held at 11AM.

          Day 31 (April 20) Went to court at 10:30AM for my case. Wasted time till 1PM. Got stood up. No papers came from police, no case heard. Time wasted in the heat. Anyways, went to PBK to check on the bike. Progressing well. Would be done by 21st. In the evening, complained about the morning incident to the seniors of the person handling my case. Threatened that I would complain to Police Commissioner if things are not hurried up now.

          Day 32 (April 21) Got a call from PBK at 11:18AM. Bike ready for delivery. Total bill = Rs.10400. No sign of insurance money coming anywhere soon. @ 1:00 PM, Reunion!! Felt like heaven.. even in the 40+deg summer heat.. I had never thought i would eventually miss it so much.. anyways.. hopefully will get police documents tomorrow morning.

          Day 33 (April 22) Judgement Day! (Literally)
          Called up police guy (Head Constable) in the morning @ 8AM. He tells me to come by between 11-12AM. So i call him again at 10:45, he doesn't answer. Kept trying till 11, no answer. Papa gets pissed, sez he wants to complain about this in Police commissioner office. At 11.15, we head to Police commissioner office (which is like 800 mt from my house), head to the office of an old contact. He wasnt there, but there was a youngish fellow in his office, in uniform(khakee) but not wearing shoes, so, decided to consult him on our situation. We told him everything what has happened in like 90 seconds, he picks up his phone, makes a call, and tells us to go to my concerned Police Chowki and meet the fellow. While going out, i try to read his name(off his badge).. it said paro..(sumthing i didnt properly read)

          @11:30AM, We call our head constable fellow again to check status (from inside the car). He tells us to come over, we were on our way.

          @11:50AM, We reach Police chowki, and see the head constable (Off duty BTW) sincerely completing paperwork in front of my eyes, i could'nt believe my eyes! Soon, he started returning my stuff, Insurance cover note, Driving license(both originals). During the time he is writing, he briefly mentions the name "Paropkari".. I ignored this. Soon we head towards Police Station (which is 300 mt away from Chowki) as panchnama requires signature of Station Head (Senior PI).

          @12:15PM We reach Police station, the Head constable is running around frantically trying to complete all formalities and to the copies and getting them attested! I was still like . Suddenly Senior Police Inspector calls us to his cabin. Makes us sit down. Asks us if we need anything.. we were still . Calls head constable, tells him to hurry up the Non Cognizable case and get it to court at the earliest. Then he tells me to go to court and accept the mistake, pay 1k fine and leave. Then all of a sudden.. he pulls out his phone, calls up someone, addresses him a "Sir", and tells him Bhatias are here, and their work here is almost done.

          Then he asked me, "Is ACP Paropkari your friend?"
          I said, "Yes"(That was the moment i realized that the person we ran into at Police Commissioner office was an ACP)

          Anyways.. at 12:40PM, We head toward court with all documents duly completed / signed / returned. We meet the constable who will be getting our case papers registered and getting my case done. For the record, I was booked under section 184 of motor vehicle act(Rash and negligent driving). I was told "Aap khaana kha ke aao, aapka case 2.30 ko lagwa dete hain." (Please go home and have lunch, we will get your case heard at 2.30PM)

          @1:00 PM, we started for home, but could not return to court till 2:57PM.

          @3:10 PM, My case was heard, I pleaded guilty. At 3:11PM, the judgement was passed, Fine of Rs.1000.

          @3.20 PM, Fine paid, copies of fine paid receipt made, we head to insurance company to submit the copies of documents received through the day today.

          @3:40 PM, We reach Insurance company, do the aforementioned, talk to the branch manager(who happens to be my neighbour)[relevant details of the conversation to be mentioned in a later post].

          @4:10 PM, Reached home.. and.. finally FREEDOM!

            How to claim your bike from the Insurance Company

            hey guys ANY 1 having any IDEA about how to do INSURANCE CLAME after something happen to bike .

            what i know is first give a F.I.R to the local POLICE STATION .

            then inform the INSURANCE COMPANY .

            N then to the SERVISE CENTER WHERE you SERVISE ur BIKE .

            LEGAL DOCS ;

            1. REGD BOOK
            2. INSURANCE COPY
            3. VALID DRIVING LICENCE
            4. TAX TOKEN

            AFTER INFORMING THE INSURANCE COMPANY , THEY WILL SEND A SURVEYER

            TO SEE THE VEHICLE , WHAT TYPE OF DAMAGE IS THERE , WHAT PARTS YOU HAVE CLAMED THEN HE WILL SEND THE REPORT TO LEGAL DEPT .
            AFTER THAT ITS THEIR DUTY TO CLOSE THE CLAME AS SOON AS POSSIABLE .

            BUT NOTE THEY HAVE * CONDITIONS APPLY FOR CLAME .

            THERE IS A LIST OF THAT IN BACK SIDE OF UR POLICY .

            SO DO ALWAYS UPDATE UR DOCS OF UR VEHICLE .
            N READ THE FOLLOWING CONDITIONS CAREFULLY

            HOPE THIS WILL HELP U IN UR LIFE .........

                  because if he will clam then insurance company will check all legal docs ...

                    First Information Report (FIR) is not mandatory unless you're filing a case against someone responsible for the damage. Incase FIR is being filed, supporting evidences in form of AR (Accident Report), hospital bills (in case of injury) will add strength to the case. Also after filing FIR, one has to take the vehicle to applicable RTO for the inspector to inspect & certify the damage.

                    PS - Posting entirely in capital letters is considered as yelling in public forum; avoid SMS language as it is prohibited in this forum.

                      Yup.

                      I have had few minor accidents/scratches in my car, I generally give the car to dealers (Claimed at Indus, A.M Motors) with the insurance claim fee of 500 and they take care of everything. It should be same with the motorcycles too.

                            Insurance companies would cover only physical damage I think.
                            For damage to engine, claim it from manufacturer if bike is under warranty, or pay out of your pocket in case warranty is over.

                                U got everything right but by personal experience some tips..
                                if u take a FIR saying accident with some other vehicle insurance agent will sometimes want to see with which vehicle u crashed! so what i did when i met with an accident was that i claimed saying i hit a dog and fell, claimed through my garage not showroom(claiming from showroom can turn out quite a hole in our pocket and adjustments wont be possible although procedure will be simple!) .so this is quite clear! i just lied abt some area ! (make sure the lie doesn change) and thats all. agent comes and says to which all part warranty can be issued after close inspections (break anything u want new )after he issues buy those parts only(dnt buy what he hasn issued cos he wont pay u for it) and call him up, he'll come n take a look at old broken parts which were replaced and ask u to collect a cheque from office after showing some id. all done.
